Vagrancy Is No Longer a Crime as Law Ends Discrimination Against the Poor |

Republic Act No. 10158, enacted on March 27, 2012, decriminalized vagrancy in the Philippines by amending Article 202 of the Revised Penal Code. This reform addresses the unjust penalization of the poor and homeless, who were previously targeted under vagrancy laws for merely wandering without visible means of support.

The law mandates the dismissal of all pending vagrancy cases and the immediate release of individuals serving sentences for vagrancy, provided they are not detained for other offenses.

However, while vagrancy is no longer a crime, the law continues to penalize women involved in prostitution, raising concerns about its discriminatory impact and failure to address systemic issues.

Republic Act No. 10158 is a significant step towards fairness and equality, ensuring that poverty is no longer treated as a crime.
