Legal Protection โ Part 3: Temporary & Permanent Protection Orders (TPO & PPO)
๐ Last week, we discussed Barangay Protection Orders (BPO), a quick remedy for women facing abuse. Now, letโs talk about Temporary and Permanent Protection Orders (TPO & PPO), which provide stronger, longer-term protectionโnot just for women, but also for children in need of legal safeguards.
๐น What are TPO & PPO?
Under RA 9262 (Anti-VAWC Law) and other family-related laws, courts can issue these protection orders to ensure the safety of victims:
โ Temporary Protection Order (TPO) โ Issued by the court within 24 hours after filing. It is valid for 30 days while awaiting a PPO.
โ Permanent Protection Order (PPO) โ A final ruling that has no time limit, ensuring long-term legal protection.
๐น What Can a TPO or PPO Do?
These orders can:

Prohibit contact between the abuser and the victim

Remove the abuser from the home
โ
Grant custody and financial support to the victim or their children

Restrict further harassment or threats
๐น Who Can File for a TPO or PPO?
๐ฉ Any woman experiencing violence from a spouse, partner, or family member
๐จโ๐ฉโ๐ฆโ๐ฆ A parent or legal guardian on behalf of a minor child facing abuse
๐ฅ Concerned individuals (relatives, social workers, law enforcers) can file on behalf of the victim
โ Legal Perspective: Why TPO & PPO Matter
๐ฉโโ๏ธ A BPO offers immediate protection but lasts only 15 days. A TPO extends protection to 30 days, while a PPO ensures indefinite legal safeguards.
๐ฉโโ๏ธ Protection orders are not limited to womenโthey can also be sought by parents protecting their children from abuse. A relevant case in U.S. jurisprudence, Knutson v. Curry, even examined the right of a father to seek a protection order on behalf of his child, emphasizing that courts prioritize the best interest of the minor.
