A wife discovers her husband’s affair but later reconciles with him and they resume living together as husband and wife. If she later files for legal separation based on the same affair, the husband may raise condonation as a defense.

Under Article 56 of the Family Code of the Philippines, condonation or forgiveness can be a defense against a petition for legal separation.

💡 What is condonation?
It happens when the offended spouse knows about the wrongdoing of the other spouse but chooses to forgive and continue the marital relationship.

⚠️ The court will still examine the facts of each case to determine if true forgiveness and reconciliation happened.

Did you know that what you post online can have legal consequences?

📌 What is Libel?
Libel is the act of publicly making false statements that harm a person’s reputation.
In the Philippines, libel is punishable under the Revised Penal Code, and it also applies to online posts, comments, and shares under Cybercrime Prevention Act of 2012 known as "cyberlibel"

📌 Examples of Cyberlibel
• Posting false accusations on social media
• Publishing unverified claims that damage someone’s reputation
• Sharing defamatory content even if you are not the original author

📌 Why You Should Be Careful Online
❗ Deleting a post does not erase liability
❗ Even “sharing” or “commenting” may lead to responsibility

⚖️ Did You Know? Kidnapping Can Include Failure to Return a Minor

Recent news involving Claudine Barretto has brought public attention to the crime of kidnapping and failure to return a minor under Article 270 of the Revised Penal Code.

📘 What does Article 270 mean?
It applies when a person is entrusted with the custody of a minor and deliberately fails to return the child to the parents or legal guardians.
This can be considered kidnapping, even without force, if the child is kept without lawful reason.

💡 Key point:
Consent to temporary custody does not give the right to keep a child permanently or against the will of the parents or guardians.

🛑 AWARENESS: ONLINE BULLYING IS NOT “JUST A JOKE”

Many children in the Philippines experience cyberbullying every day — in group chats, online games, comment sections, and social media.
What others call “biro lang” can already be:
❗ harassment
❗ emotional abuse
❗ a violation of the law
👶 CHILDREN ARE PROTECTED BY LAW
If the victim is below 18 years old, the law is stricter.
Parents can take action under:
✔️ Anti-Bullying Act (RA 10627) – schools must investigate
✔️ Cybercrime Prevention Act (RA 10175) – for online harassment & cyberlibel
✔️ RA 7610 – protects children from emotional and psychological abuse
Online bullying can lead to school sanctions and even criminal liability.

🚨 WARNING SIGNS A CHILD IS BEING CYBERBULLIED
Parents, watch out for:
Sudden silence or fear of using phone
Crying after going online
Refusing to go to school
Drop in grades
Social withdrawal
These are not attitude problems — they may be cries for help.

⚖️ WHEN TO SEEK LEGAL HELP
Seek legal consultation if:

A recent viral video shows former COMELEC Commissioner Rowena Guanzon confronting a man at a Makati mall after he allegedly told her to leave because she “might spread infection.” She later filed a complaint, highlighting how words or actions that cause unnecessary annoyance, humiliation, or distress may fall under unjust vexation under Article 287 of the Revised Penal Code.

💡 What is Unjust Vexation?
It refers to acts that intentionally disturb, irritate, or embarrass someone without any lawful reason. Even if no physical harm is done, causing another person undue stress or humiliation may be legally actionable.
