In the vast majority of cases where the victimโ€™s intent to end his life is provenโ€”and the driver was operating the vehicle within the bounds of the lawโ€”the driver is NOT HELD LIABLE for reckless imprudence resulting in homicide. The law recognizes that a vehicle, when used legally, is not a weapon of the driver's choosing in these tragic circumstances.

LIABILITY OF A DRIVER WHO STRIKES A PERSON FALLING FROM AN ELEVATED STRUCTURE:

On February 11, 2026, a tragic incident occurred at the LRT-1 Fernando Poe Jr. Station in Quezon City, where a 23-year-old student fell from the platform onto the northbound lane of EDSA. Reports from the Quezon City Police District (QCPD) indicate the victim may have jumped, landing on or being struck by a passing vehicle.

This incident raises complex legal questions regarding the liability of a driver who strikes a person falling from an elevated structure. While the emotional toll on the driver is immense, the legal question usually centers on two pillars: PROXIMATE CAUSE and RECKLESS IMPRUDENCE RESULTING IN HOMICIDE.

THE DOCTRINE OF PROXIMATE CAUSE:

In any homicide case involving a vehicle, the prosecution must prove that the driverโ€™s actions were the "PROXIMATE CAUSE" of the death. Proximate cause is defined as that cause which, in a natural and continuous sequence, unbroken by any efficient intervening cause, produces the injury.

โ€ข THE INTERVENING ACT: The victimโ€™s intentional act of stepping into the path of a moving vehicle is often viewed as an EFFICIENT INTERVENING CAUSE. This breaks the chain of causation between the driverโ€™s operation of the vehicle and the resulting fatality.

โ€ข THE "BUT FOR" TEST: Courts ask, "But for the driverโ€™s actions, would the death have occurred?" While the car technically caused the trauma, the legal focus shifts to who initiated the sequence of events. If the driver was following all traffic laws, the "cause" is legally attributed to the deceasedโ€™s intent.

Most drivers in these scenarios are charged with the RECKLESS IMPRUDENCE RESULTING IN HOMICIDE. To be found guilty, the state must prove that the driver showed a voluntary, but not willful, lack of precaution in situations where danger was foreseeable.

DEFENSE OF FORESEEABILITY: A driver is generally not required to anticipate "insane" or "extraordinary" acts. For example, if a person leaps from an overpass or darts out from behind a pillar directly into a car's path, the law typically finds that the driver could not have foreseen such an event.

"LAST CLEAR CHANCE" DOCTRINE: This is the most common hurdle for drivers. The doctrine suggests that the person who has the last clear opportunity to avoid an accident, notwithstanding the negligence of the other party, is considered responsible.
Even when a driver is clearly not at fault, they often face a "PRESUMPTION" of negligence in the immediate aftermath of a fatality.

1. THE BURDEN OF PROOF: The driver must often demonstrate that they were adhering to the speed limit and maintaining their vehicle (e.g., working brakes).

2. DASHCAM EVIDENCE: This has become the "silver bullet" for drivers. Video evidence showing that almost immediately after hitting the pavement, the student was struck by a passing vehicle is the only way to definitively prove a lack of reckless imprudence.

SUPREME COURT RECOGNIZES PROPERTY RIGHTS FOR SAME-SEX COUPLES

The Supreme Court has ruled that same-sex couples living together can be recognized as co-owners of property, as long as there is proof of actual financial contribution.

The (SC) has ruled that same-sex couples who live together may be recognized as co-owners of property under Article 148 of the ๐˜๐˜ข๐˜ฎ๐˜ช๐˜ญ๐˜บ ๐˜Š๐˜ฐ๐˜ฅ๐˜ฆ, provided there is proof of actual contribution.

In a Decision written by Associate Justice Jhosep Y. Lopez, the SCโ€™s Second Division granted a womanโ€™s complaint for partition of property and recognized her as a co-owner of the house and lot she shared with her same-sex partner.

Article 148 of the ๐˜๐˜ข๐˜ฎ๐˜ช๐˜ญ๐˜บ ๐˜Š๐˜ฐ๐˜ฅ๐˜ฆ governs the property relations of couples who are living together but cannot legally marry, acknowledging co-ownership based on their actual contributions.

The two women lived together as a couple. A year into their relationship, they purchased a house and lot, and agreed to register the property in one partnerโ€™s name to facilitate banking transactions.

Upon separation, they agreed to sell the property and divide the proceeds equally. One partner signed an ๐˜ˆ๐˜ค๐˜ฌ๐˜ฏ๐˜ฐ๐˜ธ๐˜ญ๐˜ฆ๐˜ฅ๐˜จ๐˜ฎ๐˜ฆ๐˜ฏ๐˜ต stating that the other had paid about 50% of the purchase and renovation costs.

However, she later refused to sell the property and denied that her former partner was a co-owner.

To protect her interest, the former partner annotated an adverse claim on the title and demanded partition of the property. When this failed, she filed a case for partition of real estate and damages, relying on the ๐˜ˆ๐˜ค๐˜ฌ๐˜ฏ๐˜ฐ๐˜ธ๐˜ญ๐˜ฆ๐˜ฅ๐˜จ๐˜ฎ๐˜ฆ๐˜ฏ๐˜ต as proof of co-ownership.

The SC granted the complaint for partition of real estate, as it clarified the provisions in the ๐˜๐˜ข๐˜ฎ๐˜ช๐˜ญ๐˜บ ๐˜Š๐˜ฐ๐˜ฅ๐˜ฆ governing the property relations of unmarried couples living together.

Article 147 applies to unmarried couples who may legally marry. Property acquired during their cohabitation is presumed jointly owned.

Article 148, on the other hand, applies to couples who are not permitted to marry. Only properties obtained through actual contribution are considered common property.

Since the ๐˜๐˜ข๐˜ฎ๐˜ช๐˜ญ๐˜บ ๐˜Š๐˜ฐ๐˜ฅ๐˜ฆ only allows marriage between a man and a woman, the SC held that same-sex couples necessarily fall under Article 148.

Here, the SC found that the signed ๐˜ˆ๐˜ค๐˜ฌ๐˜ฏ๐˜ฐ๐˜ธ๐˜ญ๐˜ฆ๐˜ฅ๐˜จ๐˜ฎ๐˜ฆ๐˜ฏ๐˜ต, where one partner admitted that the other paid about half of the property costs, was a binding admission and sufficient proof of actual contribution. This established co-ownership.
