Real estate has an easy-to-spot return of investment however it would be best if you conduct due diligence as you might end up buying a problematic property. You have to understand the risks that come with them.

Here are some suggestions that may perform before buying a property.
1. Get CTC of title from the Registry of Deeds to check if there are annotations on the last page like encumbrances, pending court case, adverse claim and mortgage.
2. Get tax clearance or certificate of non-delinquency of payment. Need to know if annual real property tax is paid and updated.
3. Hire a geodetic engineer to perform a re- survey on the property. This is validate the veracity of the technical description and boundaries.

Tax declarations and receipts are not conclusive evidence of ownership, that is why investors should take necessary pre-cautions in buying real estate covered by a TD.
These are some suggestions to at least minimize the risk on investing on untitled property.
1. Request for trace back / forward transactions. This will help you understand the chain of ownership and know the present owner of the property.
2. It would be better if the registered owners are still living however if deceased, need to check the legal heirs.
3. Make a family tree to visually document the ancestry or relationship from the deceased registered owners down to the living legal heirs.
4. If sole heir or the only living person who is legally entitled to inherit the estate, accomplish a Deed of Self Adjudication with Sale. Or if there are many surviving heirs, Extra Judicial Settlement of Estate with Sale should be accomplished.
5. All legally entitled heirs must sign the Deed of Instrument.

It is highly recommended to always conduct due diligence if you're planning to buy real estate. It is for your own benefit if you'll do some documents checking and verifications.
We every time hear " clean title " from the real estate agents or even from the property owners but it is best to secure a CERTIFIED TRUE COPY of title from the Registry of Deeds to check if there are annotations on the last page.
There SHOULD NOT HAVE entries like :
1. Encumbrance to individual or corporations, mortgage to bank or any loan institution, adverse claim.
2. Notice of LIS PENDENS, pending case in court.
3. Boundary dispute or encroachment to adjoining lots.
And lastly, if you find it strenuous to understand the legal terms on the annotations, it is advise to consult a lawyer.

4 Ways to Verify Authenticity of Title

1. Scan the QR code. Using your cellphone device, you'll know the title number & location and the technical description.
2. Check the paper. It is similar to paper bills & checks which also possesses fiber, intaglio, colored dots & watermarks.
3. Check the serial numbers. Compare the serial number on the upper left corner & right lower corner, it should be conforming.
4. Bring the title to the Registry of Deeds for conformity check.
