What is an Affidavit of Non-Filing of ITR?

Affidavit of Non-Filing of ITR is a sworn statement made by a person who did not file an Income Tax Return (ITR) because they are not required by law to do so.

This is often used when applying for government benefits, scholarships, or loans — as proof that you have no income or that your income is below the taxable level.

A student or dependent with no source of income
A housewife / unemployed individual
A minimum wage earner whose income is tax-exempt

Not everyone with a stamp is a legit notary! 🧐

How to Identify a Fake Notary Public

A legitimate notary must have:
✅Current Notarial Commission (valid for 2 years)
✅Official Receipt (OR) from BIR
✅Notarial Register (hardbound book)
✅Assigned notarial office (with posted commission)

Authorized seal with:
✅Notary’s name
✅Commission number
✅Serial number
✅Place & expiration of commission

If a person only uses a stamp, or notarizes documents in random places, without proper identification procedures or logbook, they might be fake.

Why Fake Notarization Is Dangerous
Fake notarization can cause:

🚩Invalid documents – your contract may be rejected.
🚩Legal consequences – fraud cases or charges for using falsified notarization.
🚩Identity risks – your ID copies and signatures may be misused.

What the Law Says

Under the Revised Notarial Practice Rules (2004) and the Revised Penal Code:
-Impersonating a notary is illegal.
-Using a fake notarization may be considered falsification.
-Penalties can include fines, imprisonment, and civil liability.

A few red flags:
🚩 No office address or visible commission
🚩 Unofficial-looking seal
🚩 Suspiciously cheap “rush” offers
