Nullity vs. Annulment of Marriage (Philippines)

Many Filipinos use the word “annulment” for everything, but legally, there are two different cases:

✅ Declaration of Nullity of Marriage
✅ Annulment of Voidable Marriage

1️⃣DECLARATION OF NULLITY (VOID MARRIAGE)

A void marriage is invalid from the very beginning.
Meaning: it’s as if the marriage never legally existed.

👉When to use Nullity?
✅Use it when the marriage is void from the start — meaning the defect is so serious that it prevents a valid marriage from existing.

2️⃣ANNULMENT (VOIDABLE MARRIAGE)

A voidable marriage is valid at first, but it can be cancelled by a court because of specific defects.

Meaning: the marriage exists until annulled.

👉When to use Annulment?
✅Use it when the marriage was valid at first, but there’s a ground that allows it to be voidable and later cancelled.

What Is Legal Separation and What Are Its Effects?

Legal separation is a court process where spouses are allowed to live separately, but the marriage bond remains intact. In simple terms: you are still married in the eyes of the law, but you are no longer required to live together as husband and wife.

This remedy is governed by the Family Code of the Philippines and is often misunderstood as “divorce.” It is not.

What legal separation does (and does NOT do):

◾ The marriage is NOT dissolved.
The spouses remain legally married.

◾ No right to remarry.
Since the marriage still exists, neither spouse may marry another person.

◾ Right to live separately.
Spouses are no longer obliged to cohabit or render marital duties to each other.

◾ Inheritance consequences.
The offending spouse may be disqualified from inheriting from the innocent spouse.

👉Who usually files for legal separation?
Spouses who have valid grounds (such as repeated physical violence, abandonment, or infidelity) but do not want to end the marriage completely—often for religious, moral, or personal reasons.

Bottom line:
Legal separation changes the effects of marriage, not its existence. If the goal is to remarry or to declare the marriage void, legal separation is not the proper remedy.
