Under the announced Skilled Migrant Category changes, Chef is included on the Amber List.

Being on the Amber List doesn't automatically tell you whether you can or can't apply for residence.

One of the biggest mistakes people will make...
..is assuming their pathway will be the same as someone else's.

It may not be.

Under the announced Skilled Migrant Category changes, occupations on the Red List are not eligible for the new Skilled Work Experience or Trades & Technician pathways. People working in these occupations may still be eligible through the Points-Based pathway, provided they meet the relevant requirements.

This is why understanding your occupation matters.

Two people can work in similar industries...

Have similar experience...

Even work for the same employer...
..and still have completely different residence pathway options.

What Does It Actually Mean?

Have you heard someone say...

"My occupation is on the Amber List... does that mean I can't get residence?"

We've already heard this question many times.

The answer isn't as simple as "yes" or "no."

Under the new Skilled Migrant Category, occupations on the Amber List may still be eligible under the Skilled Work Experience pathway, but they must meet additional pathway requirements. They are not eligible for the new Trades & Technician pathway.

The important thing to remember is this...

Your occupation is only one part of the picture.

From 20 July 2026, changes to the Pathway Student Visa will come into effect, making study pathways more flexible and easier for students to navigate.

Under the changes:

βœ” Year 12 and 13 students will no longer need to confirm the exact tertiary discipline they plan to study
βœ” Students will only need to confirm the qualification level and education provider
βœ” Pathway Student Visas will include study at Levels 1 to 4, including English language, foundation, and vocational programmes
βœ” Students progressing to Levels 1 to 8 may complete up to 30 weeks of English language study

There is no change to the list of education providers eligible to offer the Pathway Student Visa.

These updates may provide students with greater flexibility when planning their education journey in New Zealand.
