No One Can Be Arrested for Another Person’s Alleged Offence

On January 30th, 2026, in the case between Mr. Smart Onomiruren v. Pastor Samuel Idiokita, (SC/CV/747/2024), the Supreme Court of Nigeria reaffirmed a critical safeguard under section 7 of the Administration of Criminal Justice Act (ACJA) 2015, - no person may be arrested for another person’s alleged offence.

The case arose after Pastor Samuel, who was not a party to an alleged business transaction involving his son, claimed he was arrested, detained, and pressured to produce that son. He filed a fundamental rights action, arguing that the detention and threats violated his constitutional protections. The courts ultimately upheld his position, awarding damages and restraining further intimidation by officers within the Nigeria Police Force.

Beyond the legal doctrine, this case highlights real accountability: damages were upheld for unlawful detention, and restraining orders reinforced that investigative pressure cannot override constitutional rights. The matter progressed from the High Court to final determination in under five years, a meaningful signal for access to justice in fundamental rights litigation.

The 1st Respondent (Pastor Samuel) was represented throughout by E. K. Omare & Co., underscoring the role of sustained legal advocacy in protecting civil liberties involving authorities within the Nigeria Police Force.
