Prof Cheluchi Onyemelukwe was a panellist at the recently concluded Guild of Medical Directors’ discussion on " The Role of Medical Entrepreneurs in Preventing Medical Negligence and Enforciing Patient Rights in Compliance with the Code of Medical Ethics in Nigera_", where she delivered a presentation on the intersection between medical jurisprudence and healthcare delivery in Nigeria, examining decided cases and providing practical guidance for medical entrepreneurs on prevention, compliance, and the enforcement of patient rights in line with the Code of Medical Ethics.

The discussion was timely, particularly in light of current concerns about patient safety and the protection of patient rights nationwide. It also provided a valuable platform to reinforce accountability, risk management, and ethical best practices in the healthcare sector.

Beyond public reaction, these matters present ongoing regulatory and medico-legal concerns that necessitate careful review of individual cases, internal review of processes by health facilities and necessary system-wide improvements.

In this article, we examine the concept and review the legal and regulatory framework, while analysing the recently inaugurated Taskforce on Clinical Governance and Patient Safety, and propose a practical roadmap for strengthening patient safety in Nigeria.

President Bola Ahmed Tinubu recently inaugurated the National Taskforce on Clinical Governance and Patient Safety to strengthen Nigeria’s health system by establishing and operationalising sustainable clinical governance and patient safety standards and structures, as stated in the taskforce’s terms of reference.

Some of the objectives of the task force include:

- Strengthen coordination among federal, state and other regulatory bodies
- Establish national indicators and monitoring systems to track quality and patient safety performances
- Develop and standardise national clinical guidelines and patient safety frameworks
- Strengthen systems for prevention reporting, learning and response to adverse events

It remains to be seen how this will work alongside other health legislation and policies, such as the National Health Act, as the interaction between the newly established National Taskforce on Clinical Governance and Patient Safety and existing frameworks will be crucial.

Despite global commitments to achieve Universal Health Coverage (UHC) by 2030, about 76% of Nigerians pay for healthcare out of pocket (OOP), which is associated with a heightened risk of catastrophic health expenditures, hampering the desired progress toward universal coverage.

Though the National Health Act and the National Health Insurance Act mandates health coverage for all, onerous healthcare costs force individuals to delay or skip care, worsening health and economic outcomes. Government action to enhance financial protection and eliminate out-of-pocket expenses, especially for vulnerable groups, is essential to ensure a basic care package (prevention, diagnosis, medicines) for everyone, and fund vulnerable groups through the Basic Health Care Provision Fund (BHCPF), shifting from voluntary to compulsory insurance to reduce out-of-pocket costs and achieve Universal Health Coverage (UHC).

This access to affordable healthcare is crucial for healthier, resilient communities and progress toward Sustainable Development Goals.

On Universal Health Coverage Day, we call on governments and institutions to strengthen the mechanisms that make healthcare accessible to all.
