A Deed of Assignment and a Deed of Gift can both be used in connection with the transfer of an interest in property, but they are fundamentally different instruments.
📌 A Deed of Assignment is generally used to transfer an existing interest in property from one party to another. It is commonly associated with transactions where there is consideration, such as the sale or transfer of an interest in land.
📌 A Deed of Gift, as the name suggests, is used where property or an interest in property is voluntarily transferred as a gift, rather than as a transaction for a purchase price.
📢The distinction is therefore not simply about the name written at the top of the document. The nature of the transaction, the interest being transferred, the intention of the parties and the applicable legal requirements all matter.
There may also be additional requirements and formalities involved in transferring interests in land, depending on the nature and location of the property.
This is why using a document simply because someone says it is the “usual one” may not be enough. The appropriate legal instrument should reflect the actual transaction taking place📃
When property is involved, getting the documentation right from the beginning can save you from significant complications later.
