We are proud to announce a significant legal victory for our client at Deluxe Legal and Consultancy.
Our team recently secured a court judgment affirming that Customary Marriage is a recognized and legally valid marriage under Nigerian Law, and that it can be used as credible proof of marriage in a foreign jurisdiction.
In this matter, the defendant claimed in his defence that there was no valid marriage between him and our client, on the basis that they were from different ethnic groups and that the elements of marriage from his ethnic group’s tradition were not fulfilled. He further claimed before a foreign court that he was never married to our client, which necessitated the filing of this suit before a Nigerian court to determine the legality of the customary marriage. Consequently, the court held that since our client is of Yoruba origin, the relevant question was whether the elements of a Yoruba customary marriage were present, and it found that they were. The court accordingly held that the marriage was legal and recognised under Nigerian law.
This ruling carries enormous significance not just for our client, but for countless Nigerians whose unions are rooted in customary tradition and who interact within international legal frameworks.
It reinforces a fundamental principle: that Nigeria’s legal system respects and upholds its cultural heritage.
