7 Documents Every Serious Property Buyer Must Verify Before Paying for Land in Nigeria

One of the biggest mistakes many property buyers make in Nigeria is assuming that once a seller presents documents, the property is automatically safe to purchase. Unfortunately, that assumption has caused many people to lose millions of naira through fraudulent transactions, defective titles, government acquisition issues, family disputes, and improper documentation.

Over the years in legal practice, I have seen people purchase land without conducting proper due diligence, only to discover later that the property was already under dispute, affected by government acquisition, sold to multiple buyers, or lacking valid legal title. In many cases, the warning signs were there from the beginning, but they were ignored.

Before making payment for any property in Nigeria, there are certain critical documents every serious buyer must carefully verify.

1. The first document is the Survey Plan. This document helps confirm the exact location, size, and position of the land. Through proper charting and verification, a buyer can determine whether the property falls under government acquisition, committed acquisition, excision, or free land. Many people fail to verify the survey properly, and this mistake has led to severe financial losses for countless property investors.

2. The second important document is the title document. Whether it is a Certificate of Occupancy (C of O), Governor’s Consent, Gazette, Registered Deed of Assignment, Court Judgment, or Deed of Gift, the authenticity and legal validity of the title must be independently verified. Buyers should never rely solely on photocopies, verbal assurances, or representations made by sellers or agents.

3. Another very important document is the Deed of Assignment. This document helps establish ownership transfer and forms part of the chain of title. A defective chain of title can expose a buyer to future disputes and litigation. Proper legal review is necessary to ensure that the seller truly possesses the legal authority to transfer ownership of the property.

4. A proper Land Registry Search is also extremely important. This helps reveal whether there are encumbrances, mortgages, caveats, pending disputes, or existing interests affecting the property. Many hidden legal issues can only be discovered through proper registry investigation and due diligence.

5. In many parts of Nigeria, especially in developing areas, family and community consent must also be verified carefully. Several lands are family-owned, and failure to obtain proper consent or verify family authority can result in multiple sales, ownership disputes, and prolonged litigation. This remains one of the most common problems affecting property transactions today.

6. Physical inspection and neighborhood investigation should never be ignored. Sometimes the documents may appear satisfactory, yet serious problems exist on the ground. Independent inquiries within the neighborhood can reveal disputes, access issues, ownership controversies, or other hidden risks that documents alone may not disclose.

7. Most importantly, every serious property transaction should involve proper legal due diligence by a competent property lawyer. Many people spend enormous amounts acquiring property but attempt to avoid professional legal guidance. In reality, the cost of legal due diligence is insignificant compared to the financial and emotional consequences of purchasing defective property.

Property is not wealth until the documentation is secure.

Before sending money for any land or property transaction in Nigeria, ensure that proper verification and due diligence have been professionally conducted. Prevention will always be cheaper than litigation.

Friday evenings are often more than just the close of work. They are moments of reflection.

As I wrapped up today’s meetings, property transactions, client consultations, and business discussions at the office, I was reminded that the practice of law goes far beyond drafting documents or appearing in court.
