📖 When Tradition and the Law No Agree

For many families and communities, some practices don dey for generations.

People do am because:

"Na our culture."
"Na so we meet am."
"Our parents do am too."

But make I ask:

If a practice fit cause pain, injury or long-term harm to a child, should culture alone make am acceptable?

📖 Section 6 of the VAPP Act says:

Female circumcision or ge***al mutilation of a girl child or woman is prohibited.

In simple terms:

The law no allow female circumcision.

And the law no go only punish the person wey carry am out.

The law go also punish:

*person wey arrange am
*person wey encourage am
*person wey help make am happen
*even person wey attempt am

Wetin be female circumcision?

Na when person cut, remove or injure part of a girl or woman's private organ for reasons wey no be medical treatment.

Most times, na young girls wey no fit make informed decisions for themselves dem dey carry am out on.

The law recognise say this practice fit cause:

*severe pain
*excessive bleeding
*infections
*complications during childbirth later in life
*emotional and psychological trauma

Because of these risks, the law see am as a matter of protecting the health, dignity and wellbeing of girls and women.

Wetin be the punishment?

Person wey perform female circumcision, or arrange another person to perform am, fit face:

*Up to 4 years imprisonment
*Or fine up to ₦200,000
*Or both

If na attempt:

* Up to 2 years imprisonment
*Or fine up to ₦100,000
*Or both

And person wey encourage, support, advise or assist another person to carry am out go also face the same punishment.

Make we reason am small🤔

Not everything wey tradition permit dey beneficial.

Sometimes wisdom require us to ask:

Does this practice protect the child or expose the child to harm?

Even Bible talk for Psalms 82:3 say:

Make we defend the weak and the fatherless; uphold the cause of the poor and the oppressed.

Every child deserve protection, dignity and care.

💥Big lesson from today:

Culture is important.

Tradition is valuable.

But no tradition should expose a child or woman to avoidable harm.

"When force, threats or pressure become offence under the law."

📖 Section 5 of the VAPP Act says:

"Any person who uses force or threats to compel another person to engage in any act or conduct — s*xual or otherwise — that harms the person’s physical or psychological wellbeing commits an offence."

The law also say any person wey attempt am
or encourage, support or advise another person to do am go still face punishment too.

Many people think say force na only when person hold another person physically.

But force fit happen through:

threats
intimidation
pressure
fear
emotional control

Sometimes, the person no even want do the thing… but fear don already corner am.

And one important thing here be say — the law no limit this matter to only s*xual acts.

Meaning say, even outside s*xual matters, if person use force or threats to pressure another person into harmful conduct, the law go hold am responsible.

Make we reason am with real-life examples.

Imagine say employer threaten worker: “If you no do this thing for me, I go sack you.”

Or somebody threaten im partner emotionally or physically just to force them into certain behaviour against their will.

Or cult boys pressure young person to join violent activity through fear and intimidation.

Many people dey see these things as: “Na normal pressure.”
“Na ordinary threat.”

But under the law, forcing person into harmful conduct through fear or coercion fit become offence.

⚖️ The law no treat coercion and intimidation lightly o.

👉 Person fit face up to 2 years imprisonment
👉 Or fine up to ₦500,000
👉 Or both

Even person wey attempt am or encourage another person to do am go still face punishment too.

Not every “yes” truly mean agreement.

Sometimes na fear, pressure or intimidation dey behind the answer.

And when force replace free choice, harm usually follows.

Even scripture warns against using power wrongly.

“Masters, treat your servants justly and fairly" Colossians 4:1

Because authority, influence or power should never become tool for oppression or control.

📖 When fear itself become offence under the law.

📖 Section 4 of the VAPP Act says:

"Any person who intentionally places another person in fear of physical injury commits an offence and can face imprisonment, fine, or both."

The law also says:

👉 person wey attempt am.

👉 or help, encourage, support or advise another person to do am
still commit offence too.

Many people think say until person beat you, injure you or touch you physically before law fit act.

But under VAPP Act, that no be the full picture.

Sometimes, fear itself fit become violence.

Meaning say, even if person never touch you physically, the law still recognise say threats, intimidation and fear fit seriously affect somebody’s wellbeing.

For example:

👉 threatening to beat somebody.
👉 using aggressive behaviour to scare person.
👉 making somebody constantly afraid of being harmed.
👉 creating fear through intimidation or violent threats.

These things fit happen for relationships, marriages, workplaces, friendships, even inside family.

And many victims dey live in silence because people around them dey say:

“But dem never beat you na.”

Meanwhile, the fear alone don already control the person life.

Make we look two real-life type scenarios:

Mr. Obi illegally enter Mr. Emeka land because he wan grab the land. When Emeka challenge am, Obi come use area boys threaten am say if dem see am near the land again, dem go kill am.

Or imagine say John ask Ngozi to date am, but Ngozi refuse. Instead of accepting her decision, John come turn the matter to threats and intimidation, trying to force Ngozi into relationship through fear.

Many people fit see these things as:

“Na ordinary threat.”
“Na anger talk.”

But under the law, intimidation and fear wey person intentionally create fit become offence.

⚖️ The law no see this kind intimidation as joke.

👉 Person fit face imprisonment for up to 2 years.

👉 Or fine up to ₦500,000

👉 Or both

And if person help, encourage or support another person to do this kind thing, the law still go still punish am too.

Some people no dey raise hand…but fear still dey everywhere around them.

And sometimes, the fear of violence can wound person deeply even before any physical injury happens.

Even scripture warns against using fear and intimidation wrongly.

“There is no fear in love. But perfect love drives out fear.” — 1 John 4:18

Because fear was never meant to be a tool for control.

📖 When emotional pressure and manipulation become offence under the law.

Some people think say violence na only when person slap, beat or injure another person physically.

But VAPP Act say e pass like that.

Under Section 3 of the Act, if you force, pressure, threaten or manipulate somebody into doing something wey go affect their physical or mental wellbeing, the law fit hold you responsible.

Meaning say: 👉 violence no be only physical.

👉 emotional and psychological pressure fit become offence too.

Make we reason am with everyday life.

For instance:

👉 threatening somebody emotionally to control them.
👉 using fear or intimidation to force person into something.
👉 manipulating somebody mentally until dem lose peace or emotional stability.
👉 pressuring person into harmful or degrading acts.

These things happen more than people realise.

And many victims dey suffer quietly because no physical mark dey their body.

One thing wey make this section deep be say:

Sometimes, person fit never touch another person physically at all… yet serious emotional and psychological damage don already happen.

That is why the law no only protect body — e also recognise mental and emotional wellbeing.

And under the law, this no be ordinary behaviour o.

👉 Person fit face up to 3 years imprisonment.

Not every wound dey show for body.

Some words, threats, manipulation and intimidation fit wound person deeply for inside.

Sometimes na emotional pressure dey push people into decisions wey later damage them mentally, emotionally, and even physically.

Even scripture warn us about destructive influence and harmful pressure.

📖 Bad company corrupts good character. — 1 Corinthians 15:33

Because many times, na toxic influence and manipulation dey quietly destroy people from inside.

👉 Not everything wey leaves scar dey leave mark for skin.

📖 When physical injury become crime under the law

Today make we talk about something wey plenty people still dey take lightly.

Beating.
Injury.
“Na small fight.”
“Na just anger.”

But under the law, e no be small thing.

Section 2 of VAPP Act make am clear:

If you intentionally cause physical injury to another person, you don commit offence.

No be only with hand.

E fit be weapon, any object, or even substance.

As long as you willfully hurt another person, the law go hold you responsible.

Some people go say,

“But I no really do am… na just attempt.”

Even attempt sef no safe you.

If you try to cause that injury, even if e no fully happen, you still fit face punishment.

Law no dey wait until damage complete before e act.

Another part wey people dey overlook:

If you encourage or push somebody to hurt another person, you are also guilty.

Even if you no touch the victim yourself.

And e still go further.

If you help person wey commit this kind offence hide or escape, knowing wetin dem do:

You don join the offence be that.

So wetin be the consequence?

Person fit face up to 5 years imprisonment, or fine, or both.

And once this kind case enter record, e fit follow person for long time.

Court fit even order compensation to the victim.

Meaning say, you go still pay for the harm wey you cause.

💭 Make we reason am small…

That “one slap”
That “push out of anger”
That “hit with anything nearby”

Fit turn criminal matter.

Even for scripture in Genesis 4:8, we see am clearly.

Cain, out of anger, killed his own brother Abel.

That one moment of anger no just end there - e changed im life completely.

God punished him as we see am in Genesis 4:11- 12, and he lived with that consequence.

One moment of uncontrolled anger fit lead to lifetime consequence.

Big lesson here:

Anger no be defence.

Emotion no be excuse for violence.

As we dey talk law, make we no forget:

👉 “Let every person be slow to anger…”
👉 “Do not repay evil for evil…”

Because both law and life dey point to one thing:

Respect human dignity.

(SECTION 1: R**E)

📖 From law… to real life… to truth

This week, we really take time talk about VAPP Act — from wetin the law be, to how e define r**e, and even how e compare with old laws wey we dey use before.

One thing wey stand out clear be say: 👉 the law don move forward… but many people still dey operate with old understanding.

So today, I no just want close am with law talk alone.

I want bring am closer to real life.

Because if (God forbid) something like this happen, the first few hours matter pass anything else.

⏰ In fact, within 72 hours, evidence still dey very strong. After that, things fit become harder to prove.

If person ever find themselves in that kind situation, some small but very important things fit make big difference:

👉First, as difficult as it may be, avoid bathing or washing clothes immediately. If clothes don already change, try keep the ones worn during the incident in a paper bag.

👉Then, go hospital as soon as possible. Not just for treatment, but also for proper medical examination and documentation. Some centres even provide support without payment.

👉Whatever you still remember—time, place, what happened—it helps to write am down quickly while memory still fresh. Even photos of injuries or torn clothing can matter later.

👉And very importantly, report the matter. Police, support centres, or any trusted legal channel. Ask for proper documentation or reference number.

👉If you get access to a lawyer, even better. Early legal guidance fit help protect your interest and make sure the right steps are followed.

⚖️ One thing VAPP Act make very clear be this:

👉 r**e no be gender-based assumption again
👉 both men and women fit be victims
👉 and consent must always be free, clear, and voluntary

Anything less, no be consent.

And to anyone wey even dey consider committing this act, make this sink in:

This no be something wey go just “pass.”

Under VAPP Act:

🔸minimum 12 years imprisonment

🔸fit reach life imprisonment in serious cases

🔸name fit enter s*x offenders register

But beyond prison, the consequences deeper pass that.

Because e dey affect everything: your future, your relationships, your opportunities, your reputation.

And sometimes, even when people move on… society no dey forget.

👉 One wrong decision fit follow person for life.

And finally, as we reflect on justice and responsibility, scripture also reminds us:

👉 Learn to do right; seek justice. Defend the oppressed - Isaiah 1:17 (NIV).

👉 Whatever a person sows, that shall they also reap - Galatians 6:7 (NIV).

THURSDAY COMPARISON 📖 VAPP Act vs Criminal Code & Penal Code on R**e Law

Make we talk truth today.

Before VAPP Act, Nigeria no get one clear, modern and balanced law wey dey handle r**e matter across board. Wetin we get be:

Criminal Code (South)

Penal Code (North)

And for years, plenty cases dey pass through these old systems.

But the big question be: 👉 Were those laws really enough to protect victims the way e suppose be?

⚖️ First, wetin all the laws agree on

Even the old laws and VAPP Act still agree on some basics:

👉 R**e na serious offence.
👉 No consent = crime.
👉 Force, threat or fraud no be valid consent.
👉 Sexual violence against children na offence (defilement/r**e of minors).

So from beginning, law don already know say this matter serious.

⚖️ But VAPP Act come change the whole level

This na where the difference dey very clear:

👉 1. Protection no dey tied to gender again.

Before:

Mostly women/girls dey seen as victims.

Now:

Anybody fit be victim (men or women).

Anybody fit be offender.

👉 Law don become more realistic.

👉 2. Definition of r**e don expand. Old laws mostly focus on narrow idea of pe*******on.

But VAPP Act talk say r**e include:

va**na

a**s

mouth

even with objects or any body part

📌 Meaning:
It’s not just “type of s*x”… na violation of body + consent.

👉 3. Marital r**e now dey recognized This one dey very serious shift.

Under VAPP Act: 👉 Marriage no be automatic consent.

But under old laws: 👉 Husband hardly fit dey charged.

So VAPP Act don change that mindset completely.

👉 4. Stronger protection for victims Now the law fit give:

Minimum 12 years imprisonment (no fine option).

🔸Life imprisonment for serious cases.

🔸Compensation for victim.

🔸Sex offenders register (public record).

Old laws no really get this structured protection system.

⚠️ One important reality check

Even though VAPP Act stronger: 👉 E still be federal law mainly for F.C.T.

👉 Other states must adopt am before e fully apply.

So implementation still dey uneven across Nigeria.

🚨 Big takeaway for today

👉 VAPP Act no just increase punishment…
E change how Nigeria law dey understand r**e itself — especially consent, protection, and victim dignity.

📖 Section 1: Wetin law talk about r**e

Last week we start the foundation of VAPP Act.

Today, we go enter one of the most serious part: 👉 R**e under Section 1 of VAPP Act 2015.

⚖️ So wetin be r**e under this law?

For VAPP Act, r**e no be only “forceful s*x” as people dey usually talk am.

Law define am clear:

👉 Person commit r**e if e pe*****te:

🔸Vagina

🔸Anus

🔸Mouth

with:

🔸Body part OR

🔸Anything else, like:

👉Fingers
👉Sex toys (like vi*****rs, di**os)
👉Bottles or similar objects
👉Pens or similar handheld items
👉Any inserted household object used to pe*****te (e.g., stick-like items, handle of tools), etc.

AND the other person no agree (no consent)

OR the consent come through:

🔸force.

🔸threat or intimidation.

🔸fear of harm.

🔸lie or fake story about wetin go happen.

🔸drugs or anything wey fit take person mind or will.

🔸impersonation (even pretending say na spouse for marriage).

📌 Meaning be say: 👉 If consent no real, no free, no clear — law fit still call am r**e.

⚖️ Punishment wey the law give

VAPP Act no dey joke with this matter:

👉 General punishment: life imprisonment

But e get breakdown:

👉If offender be below 14 years → up to 14 years prison.

👉Other cases → minimum 12 years (no option of fine).

👉If na group (gang r**e) → minimum 20 years (no option of fine).

⚖️ Protection for victim

Law no just dey punish alone:

👉 Court fit also give compensation to victim.
👉 Dem go maintain register for convicted s*xual offenders.
(so people fit know offenders)

⚖️ Why this section important

This section show us one big thing:

👉 R**e no be only force — na lack of real consent matter pass.

So even if:

no beating happen

no shouting happen

If consent no genuine, law still fit treat am as r**e.

🚨 Main thing to remember today:

👉 If consent no free, no clear, no genuine… VAPP Act fit still see am as r**e.
