*On Whether tenant entitled to refund of rent whereunilaterally surrenders tenancy -*

In a landlord and tenant relationship, there is noprovision for refund of rent if a tenant unilaterallysurrenders the premises after the contract has beenexecuted. Where such a situation occurs, the usualpractice is that the tenant will be entitled to receiverepayment of rent of the unexpired term from thedate the premises is re-let before the expiration ofthe tenancy. It is unreasonable for a tenant to expecta full refund of the rent after taking possession forsome period and thereafter deciding to terminatethe tenancy. It is feasible to entertain such a claimonly if the landlord is guilty of frustrating thecontract. [Nigerian Construction and Holding Co.Ltd. v.
