A lot of Nigerians think once court grants bail, the case is over. Well that’s false.
Bail is a temporary release from custody while your case is still ongoing. You are still presumed innocent until you are proven guilty by the Court.
So even after bail is granted to you, you will still be coming to Court from home. So if at any time you fail to be in court on the day your matter is coming up, Court will revoke your bail and a bench warrant issued on you.
Once Court grants bail, only the Court can revoke it. The person who instituted the action, the police, or the other party cannot just change their mind and send you back to custody/Prison. Bail is a Court Order, not a private agreement.
The only thing that can stop you from going home is if you fail to perfect your bail conditions. So once you perfect your bail conditions like sureties, paperwork, etc.you will be released.
What is Bail on Self Recognizance.
This is bail on your own word. The Court grants you bail because they trust you’ll show up for trial. It’s usually for minor offences, first time offenders, or people with strong community ties. So no money or surety is required if you are granted bail on self recognizance.
Bail is not an acquittal. Bail is not freedom. Bail cannot be cancelled by the complainant. Bail means “go home after you perfect your bail conditions, but come back for your case. ゚viralシ
