Court of Appeal Affirms Death Sentence On Man Convicted Of Armed Robbery In Delta

‎The Court of Appeal, Asaba Division, has affirmed the death sentence earlier handed down to 32-year-old Oghenero Oghenese, who was convicted of armed robbery by a Delta State High Court sitting in Ughelli.

‎Oghenese was tried before Justice M. N. Obi on a three-count charge of conspiracy, armed robbery, and unlawful possession of fi****ms.

‎The prosecution, led by an Assistant Director in the Delta State Ministry of Justice, Mrs. Catherine Onoberhie-Oberuomo, told the court that the offences were committed on July 1, 2014, at No. 24 Mudi Street, opposite Heroes of Faith Church, Ughelli.

‎According to the prosecution, Oghenese and others still at large robbed one Mr. Michael Ojo of ₦470,000. He was reportedly subdued at the scene by the victim and his late brother, Mr. Clement Emudianughe, before being handed over to the police.

‎Justice Obi convicted Oghenese on December 21, 2017, and sentenced him to death by hanging

‎The convict appealed the judgment in April 2025 in Appeal No. CA/AS/13C/2025. However, on March 31, 2026, the Court of Appeal dismissed the appeal and upheld both the conviction and the sentence, affirming the High Court’s decision in its entirety.

High Court Dismisses Suit Alleging Marginalization of Isoko Communities in Delta’s 2025 Budget

‎A Delta State High Court sitting in the Oleh Judicial Division has dismissed a suit challenging the Delta State Government over alleged marginalization of Isoko North and Isoko South Local Government Areas in the allocation of state resources in the 2025 Appropriation Bill.

‎The case, filed as Suit No. HCO/M/16/2025 between Ejumejowo Anthony Asuotu & Anor v. Attorney-General of Delta State & 3 Ors, came up for judgment on March 26, 2026, before Hon. Justice C. O. Emifoniye.

‎When the matter was called, all parties were absent. A. F. Ogheneruvwe held brief for G. A. Omomuwho on behalf of the Applicants, while T. F. Doigbagha appeared for the 3rd and 4th Respondents. There was no representation for the 1st and 2nd Respondents.

‎Justice Emifoniye considered four key issues for determination, including whether the court had jurisdiction, whether policy and budgetary matters were justiciable, whether the Applicants had locus standi, and whether they were entitled to the reliefs sought.

‎The court held that the Applicants failed to demonstrate any special or peculiar interest affected by the 2025 budget beyond that of other Isoko indigenes. Consequently, they lacked the requisite locus standi to initiate the suit.

‎The court further ruled that the claims centered on policy formulation and budgetary allocation, matters constitutionally classified as non-justiciable. Justice Emifoniye affirmed that courts lack the authority to determine how state resources should be allocated, advising the Applicants to instead engage policymakers within the Executive Arm to pursue their demands.

‎In an obiter remark, the judge observed that the personal appearance of the Honourable Attorney-General of the state in earlier proceedings signaled that the state government acknowledges the concerns raised by Isoko North and Isoko South local Government Areas.

‎Having resolved the critical issues against the Applicants, the court concluded that the request for substantive reliefs was rendered academic.

‎The suit was accordingly dismissed for lack of merit, with no order as to costs.

Man, Accomplice Sentence to Death for Killing Mother in Delta

‎A Delta State High Court sitting in the Kwale Judicial Division has sentenced a 44-year-old man, Lucky Edozien, and his accomplice, 33-year-old Amaechi Enuebuka, to death by hanging for the gruesome murder of Edozien’s mother, Mrs. Janeth Odinuwe.

‎Justice D.C. Maidoh delivered the judgment after finding the defendants guilty of killing the 70-year-old woman at her home in Umudike Quarters, Ossissa, Ndokwa West Local Government Area, on April 13, 2023. The court held that their actions violated Section 319 of the Criminal Code Law(CapC21Vol.1,laws of Delta State, 2006.

‎ According to the prosecution led by Assistant Director of the Delta State Ministry of Justice, Mrs. Catherine Onoberhie-Oberuomo, Edozien conspired with Enuebuka, a motorcyclist and part-time DJ, to murder his mother.

‎Edozien allegedly claimed he believed a ring worn by his mother was responsible for the hardships he was facing.

‎The court heard that Edozien promised Enuebuka musical instruments in exchange for distracting the deceased’s sister, Mrs. Paulinah Okonji, by pretending to negotiate the purchase of scrap metal located behind the house. The plan allegedly allowed Edozien to enter his mother’s room unchallenged, where he strangled her to death.

‎ Despite the absence of an eyewitness and the refusal of Mrs. Okonji to testify, the prosecution relied on the “Doctrine of Last Seen” and police investigative testimonies to establish the guilt of both men.

‎The case, HCK/54C/2023 – State vs. Lucky Edozien & Amaechi Enuebuka, concluded on March 25, 2026, with the court convicting both defendants and sentencing them to death by hanging.
