In giving testimony, note that for example stating "that as the deceased was trying to disarm the defendant, that his finger touched the trigger of the pistol & it fired"; is not the same as "that while the defendant & the deceased were struggling for the pistol that it exploded. All things equal, witness(es) testimony should be consistent".

Contradiction is stated/ analyzed by the supreme court, Emeka Agu, JSC in Adeleke v. State (1995) 2 NWLR (Pt. 377) 269 inter alia thus; "A piece of evidence contradicts another when it affirms the opposite of what that other evidence has stated not when there is just a minor discrepancy between them. Two pieces of evidence contradict one another when they are by themselves inconsistent. On the other hand, a discrepancy may occur when a piece of evidence stops short of, or contains some minor differences in details".
