There is a new Supreme Court Authority bothering on the eligibility of law firms to sign court processes.

OLOWE & Anor v. ALUKO (2025) LPELR-81320 (SC)

The Supreme Court held that where a law firm signs a process, other than a counsel, it will not be defective if the name of the law firm is solely that of the principal(s). E.g. ALUKO & OYEBODE; DUALE, OVIA & ALEX-ADEDIPE; BANWO & IGHODALO; ALADEKOJO & OTAIGBE, and so on.

The reason is because, the individuals are not only undisputedly legal practitioners but are also enrolled to practice law within the jurisdiction of Nigeria.

In that case, the writ of summons in the suit was signed by Akin Olujimi, Esq., while the statement of claim was signed by Akeredolu & Olujimi. The other party brought an objection as to the validity of the Statement of Claim.

The court held that the signature of the Statement of Claim cannot be deemed as defective. The names of the signatories are clearly identifiable as belonging to persons duly qualified and entitled to practice law under the provisions of the Legal Practitioners Act.

*Avoiding Avoidable Regrets in Investment Pt.1*

Emerald (not her real name) was excited to have found a house in a good location to buy. We were excited to have secured a new brief.

Our due diligence and findings on this first property revealed one of the major 'time bombs' to avoid in property transactions: the house that she had so much fallen in love with was relatively affordable but the existing and unpaid bills hanging on the property could get one additional property. Our advice was: "run as fast as your legs can carry you". Proceeding with that transaction would mean buying a huge liability.

Our client was disappointed as we were. She missed the house she liked so much, we missed the brief as it were; but we were all reasonable enough not to allow sentiments (on her part) and fleeting gain (on our part) to override reason and common sense.

It is in the character of vendors (sellers) to conceal secrets, but the honour of diligent professionals to unveil their hidden secrets.

When we left the first prospect, we were invited again when they were shown another property.

The tale of the next experience is much more interesting and the lessons, you cannot afford to miss.

Avoiding regrets is a major component of wisdom.
