JUSTICE AT LAST?

In June 2016, the newly appointed Manager of the Waste Management Agency in Cross River State simply ordered some workers to stop coming to work without paying them a dime of backlog of salaries they were being owed up to that point.

For years they begged the Government to pay them their entitlements. They wrote letters, went on courtesy visits and even held a peaceful demonstration. They were ignored. They approached me with their case and I took it up pro bono.

Five years later, and today, the National Industrial Court agreed with us that the workers were treated unfairly. The court has ordered the Cross River State Government to pay them Thirty Five Million, Five Hundred Thousand (N35, 500, 000) as compensation.

We wanted more… but we thank the Court and we thank God.

We pray that the government of Apostle Senator Prince Otu, who seems to be different from the past, will quickly pay the workers this money and even do more for them.

They have really suffered. Some of them could not see this day; poverty killed them before the court delivered the judgement today. Most of them still alive are barely alive, they cannot pay their rent, they cannot feed their families, they cannot treat their diseases. They need help. Urgent help.

Another Landmark Victory.

Court Awards 9million Naira Damages Against Egypt Air In Favour Of Our Client For Misplacing His Bag

This morning, the Federal High Court, Abuja, awarded the sum of N9, 000, 000 (Nine Million Naira) against Egypt Air in favour of our client, a Lt Colonel in the Nigerian Army.

The court agreed with all our submissions and held that it was negligent, willful misconduct and a breach of contract for Egypt Air not to deliver one of our client’s checked in bags when he arrived Abuja from Jordan.

Court Awards 10million Naira Damages Against Qatar Airways In Favour Of Our Client Blessing Mary Ocheido

Today, the FCT High Court, sitting in Apo, awarded the sum of N10, 000, 000 (Ten Million Naira) against Qatar Airways in favour of our client, Blessing Mary Ocheido. The court deprecated the airline for discriminating against our client on the basis of her disabilty.

In September, 2022, Qatar Airways refused to fly our client from Abuja to London, claiming that she didnt pre-inform them that she was disabled and wheelchair bound. They also refused to rebook her or refund her the money used to purchase the ticket.

We took up the matter pro bono. This is the first judgement in a couple of suits filed to seek redress for her.

Cyberstalking: Foremost Abuja Lawyer, F. Baba Isa, Esq., Obtains Judgement Discharging And Acquitting Frontline Journalist Agba Jalingo

The Federal High Court, Abuja, agreeing with the arguments of Barrister F. Baba Isa, has discharged and acquitted frontline journalist Agba Jalingo on Cyberstalking offences preferred against him by the police. This charge was instigated by one Elizabeth Alami Ayade, the in-law of the former Governor of Cross River State, Senator Ben Ayade. Upon her complaint to the police, Agba Jalingo was arrested from his residence in Lagos and brought to Abuja were after detention in police custody he was arraigned at the Federal High Court.

In CHARGE NO: FHC/ABJ/CR/565/2022, Commissioner of Police vs Agba Jalingo, dated the 6th of December, 2022 and filed on the 8th of December, 2022 the following two counts were preferred against the Defendant;
COUNT 1
That you Agba Jalingo male of No. 14 Oremeji Street, Ojudu Alapere Lagos on 30th June, 2022 within the jurisdiction of this Honourable Court, did intentionally Published Online at Cross River Watch and alleged that one Mrs. Elizabeth Ayade procured the services of one Pascal Aboh to write Nigeria Law School Examination Bar Examination for her an information you know to be false for the purpose of causing her annoyance, ill will and insult. You thereby committed an offence punishable under Section 24 (1) b of CYBERCRIMES (PROTECTION, PREVENTION ETC) ACT, 2015.
COUNT 2
That you Agba Jalingo male of No 14 Oremeji Street, Ojudu Alapere Lagos on 30th June, 2022 within the jurisdiction of this Honourable Court, did intentionally Published at your page known as Agba Jalingo that one Mrs Elizabeth Ayade procured the services of one Pascal Aboh to write Nigeria Law School Examination Bar Examination for her an information you know to be false for the purpose of causing her annoyance, ill will and insult. You thereby committed an offence punishable under Section 24(1) b of CYBERCRIMES (PROTECTION, PREVENTION ETC) ACT, 2015.

To prove these counts beyond reasonable doubt, the Prosecution called three (3) witnesses, including Elizabeth Alami Ayade, the purported the victim of the cyberstalking and tendered 9 documents.

Speaking to journalist after his client was discharged and acquitted of all charges by Honourable Justice Joyce Abdulmalik of the Federal High Court, Abuja based lawyer, F. Baba Isa, said, “At the close of the prosecution case, we elected to enter a no-case submission, confident that the prosecution had failed to prove elements of the offence our client was charged with. I argued this in an over 40-page document, and the court in a well-considered ruling agreed with me and discharged and acquitted my client, bringing to a close a two-year stressful trial.”

Efforts to reach the prosecution lawyer to find our if they will be appealing this decision of the Federal High were unfruitful as he did not take or return his calls.

I remember a divorce case I handled some years ago.

The Respondent, the wife, blatantly refused to show up in court or engage a lawyer; and the judge wasn’t ready to proceed without her.

One day in court, the judge, again, refused to proceed with the matter without the woman. That we must meet with her and hold the statutory conference before she will hear the matter. I told the judge we have served her the petition and the hearing notice for today’s sitting and clearly she is not interested in defending the petition, so, we should proceed in the interest of justice.

The judge come vex for me o. That I should do more than that. I should get her number, call her and try to see her and hold a meeting with both of them and try to settle them. E come be like say na me wan scatter their marriage.

The judge asked the petitioner, my client, if he doesn’t want settlement, he said no. He was visibly angry, talking about how he just wants a divorce immediately and nothing else. That they are still living together and that he is just waiting for the divorce to leave the house or kick the woman out.

Judge says I should still meet with both of them. Everybody knows that this is the point you must shout “As the Court pleases” to avoid wahala.

After court I collected the Respondent’s phone number from my client and called her immediately. I requested to meet with her and invited her to come to my office. Madam said she is not coming anywhere, that if I want to meet with her, my client should bring me to their house.

I went back to the office after agreeing with my client that I will come over to his house after the close of work that same day.

I went to their house by 5pm. We sat down and starting talking about the issue. Then I got a bombshell.

She: Did your client tell you that he is serious about that divorce?

Me: Yes. We are in court already. He even told the judge so this morning in court. He is here now, he can tell you himself.

She: Serious about which divorce? Is it not that court he came back from this afternoon and came and collect one doggy?

I was totally flabbergasted. I didn’t expect that kind of raw bluntness from her. I turned to my client, he was silent and avoiding my eyes.

Doggy? I carried my file quietly, entered my car and left.

Like doggy? After all that heat I faced in court, you even stood there, forming anger, then you came back and collect hot doggy in the afternoon?

What do you take lawyers for in this country? Doggy? You couldn’t even do missionary in appreciation of the lashing that judge gave me because of your divorce case, you went and did doggy. Doggy that use to sweet like wetin. 😭

It is impossible for Kwankwaso and Obi to form any partnership or merger.

Many Nigerians are excited and badly want change of guard in National leadership. I have received many calls concerning the legal possibility of an Obi and Kwankwaso combination. I'm sorry to say, this is not legally possible no matter the order of arrangement.

Obi cannot lawfully be vice presidential aspirant to anyone else in 2023, likewise Kwankwaso. Both must continue to run their separate race as Presidential candidates of their parties or quit to go back home as voters. None can legally qualify to to be vice to anyone else. Otherwise, it will amount to multiple nomination.

If they attempt to have either of them as Vice to any of them, section 35 of the Electoral Act 2022 will render such arrangement invalid. This is the law and nothing can be done about it.

Labour Party cannot also merge with NNPP even if they reach a mutual agreement to do so now. It is legally impossible because the time for merger has passed. Merger notice must be given 9 months to general election. We don't have up to 9 months between now and February when the presidential election will hold. The option of merger is off the table. Thus, Labour Party and NNPP must run their separate race or withdraw from the race entirely. The thought of merger is only but legal fantasy. It does not exist and will not happen before 2023. It's a mirage. If you were thinking of it, perish the thought.

Do you know that Electoral Act now permit agents of political parties to keep their separate evidence of election activities at polling units and such is admissible as evidence in Court. See section 41(4) of EA 2022

NEWS FROM THE FIRM - Court Awards N7.5m Against The Police, Joseph Agaji & Anthony Elor

The Cross River State High Court, Calabar Division, in Suit No: HC/22F/22, filed by our client, Benjamin Seshe, against the Inspector General of Police, Nigeria Police Force, Commissioner Of Police, Cross River State, CP Joseph Agaji, Rtd & Anthony Elor, has ordered the Police to pay our client the sum of Five Million Naira (N5, 000, 000); while Joseph Agaji and Anthony Elor were ordered to pay our client the sum of Two Million Five Hundred Thousand Naira (N2, 500, 000), jointly and severally, as damages for infringing on the fundamental human rights of our client.

The Court agreed with our argument and held that Joseph Agaji used his influence as a retired commissioner of police to procure the police to arrest and lock up our client for over a month.

Our client in celebrating this court decision said that Joseph Agaji is their son and they are ready to make peace with him and put to rest the ugly crisis that emanated from a chieftaincy tussle in Ebung Community, Bansara, Ogoja.

However, he said that the entire community has vowed that for every member of the community CP Agaji got arrested, or will get arrested in future, they will approach the court to seek redress.

Other members of the community who were locked up for several months by the police at the instance of Agaji are still in court seeking redress.
