YOU DO NOT NEED A UNIFORM TO COMMIT TORTURE.

The law is precise and uncompromising. Torture is a crime regardless of who commits it. It is not limited to law enforcement, and it is not excused by circumstance.

Under the Anti-Torture Act, 2017, any act that deliberately inflicts severe physical or mental suffering on another person is punishable. This applies to individuals, groups, and even those who act with the approval or encouragement of others in authority.

Acts commonly described as “jungle justice” are not a form of justice at all. When individuals take the law into their own hands by beating or abusing a suspect, they step outside the protection of the law and into criminal liability.

The 1999 Constitution of the Federal Republic of Nigeria guarantees the dignity of every person. That right remains intact, even in the face of suspicion or accusation. It cannot be suspended by anger, frustration, or the desire for immediate answers.

Justice is only legitimate when it follows due process. Anything less undermines the very system it claims to defend.

Respect human dignity. Uphold the law.

The prohibition of torture in Nigeria is both constitutional and statutory. Section 34 of the Constitution of the Federal Republic of Nigeria 1999 guarantees the right to dignity of the human person, explicitly forbidding torture, inhuman, or degrading treatment.

This is reinforced by the Anti-Torture Act 2017, which criminalizes any act of coercion used during investigation. Claims of “minimal force” cannot override these protections.

Any violation exposes the offender to criminal liability and undermines the legitimacy of the justice system.

“Ignorantia juris non excusat,” sometimes written as “Ignorantia legis neminem excusat,” is a cornerstone of contract law and the entire legal system, meaning “Ignorance of the law is not an excuse.” Understanding this fundamental principle is essential for anyone entering into contracts or simply navigating daily life, as it underscores your responsibility to know and understand the laws and contractual obligations that apply to you to avoid unintentional disputes.

Liability is not merely a legal term, it is the enforceable obligation that arises when a person breaches a duty imposed by law.
Under principles of tort and statutory regulation, every action or omission that results in damage, injury, or loss attracts legal consequences.

For instance, pursuant to the Federal Road Safety Commission (Establishment) Act, drivers who violate traffic regulations and cause harm may be held liable for resulting damages, injuries, or loss of life.

In essence, the law does not only prescribe conduct, it ensures that responsibility attaches where there is a breach, making accountability not just expected, but enforceable.

Caveat Emptor” is a well-known Latin legal phrase meaning “Let the buyer beware.” In business and contract law, it is a crucial principle emphasizing that the buyer is responsible for inspecting the goods or property and identifying any visible defects before making a purchase. While modern consumer protection laws have introduced some limitations, understanding this concept is still essential for both buyers and sellers to navigate transactions wisely and protect themselves from potential disputes.

Munchausen Syndrome by Proxy, clinically recognized as Factitious Disorder Imposed on Another, is not only a psychological condition but a serious form of abuse under the law.

It occurs where a caregiver deliberately fabricates, exaggerates, or induces illness in another person, often a child, for attention or sympathy.

From a legal perspective, such conduct may constitute child abuse, neglect, and in severe cases, criminal liability for bodily harm.

Raising awareness is essential to early detection, proper intervention, and the protection of vulnerable individuals.

Where there is suspicion, timely reporting can make the difference between continued harm and immediate protection.

The law does not measure intent by appearance, but by impact.

Munchausen Syndrome by Proxy involves a caregiver deliberately presenting false or induced medical conditions in another person, often a child. What may appear as concern can, in law, amount to calculated harm.

⚖️ Such actions may give rise to offences including child abuse, neglect, and grievous harm, depending on the severity of the conduct and its consequences.

From a legal standpoint, key concerns include:
• Deliberate misrepresentation of a child’s health
• Exposure of the child to unnecessary medical procedures
• Breach of the duty of care owed by a caregiver
• Patterns of conduct that place the child in foreseeable danger

The guiding principle remains clear. The best interest of the child is paramount, and any violation invites legal scrutiny and accountability.

Silence protects the offender. Awareness protects the victim.

Our ‘Word of the Week’ is “NEMO DAT QUOD NON HABET,” which translates from Latin to “No one gives what they do not have.”
This is a fundamental legal principle that serves as a cornerstone for understanding property rights, commercial transactions, and ownership transfers across many legal systems. In simple terms, it means you cannot sell, transfer, or pass a legal title to something you do not legally own in the first place. This principle often protects original property owners against subsequent buyers, even if those buyers acted in good faith, in situations involving stolen or misappropriated goods.
