Personal Data Protection Is More Than a Compliance Exercise

The recent reports involving Khairul Aming and Maxis have once again highlighted the importance of safeguarding personal data in Malaysia. While the full facts are still unfolding, the incident serves as a timely reminder that organisations entrusted with personal data must uphold their legal obligations under the Personal Data Protection Act 2010 (PDPA).

In particular:

• Section 8 PDPA on sharing of data with third parties.

• Section 9 PDPA which deals with protection of personal data against misuse

Where telecommunications and network related issues are involved, the Malaysian Communications and Multimedia Commission (MCMC) also plays an important regulatory role in overseeing compliance under the Communications and Multimedia Act 1998, working alongside the Personal Data Protection Commissioner to strengthen the protection of consumers’ personal information.

As businesses continue to embrace digitalisation, robust data governance is no longer optional, it is essential to maintaining public trust and ensuring legal compliance.
