Can non-Malawians own land in Malawi?

Under the 2022 Land (Amendment) Act, non-Malawians generally cannot own private or customary land. Land ownership is now exclusive to Malawian citizens.

Foreigners can only access land through long-term leases for investment purposes, which are subject to assessment, approval, and development conditions, rather than outright ownership.

Key Aspects of Foreign Land Ownership in Malawi

No New Ownership: Foreigners cannot buy or be granted private land.

Existing Rights: Foreigners who owned land before the 2022 amendments (and amendments to Section 37 of the 2016 Land Laws) retain their rights until their current lease expires.

Restriction on Transfer: Foreigners cannot sell or transfer land to another foreigner.

Investment Only: Non-citizens may access land for investment purposes, typically through the Malawi Investment and Trade Centre (MITC).

Development Requirement: All leases must be developed within two years, or the government may repossess the land.

Customary Land Exclusion: Foreigners are prohibited from owning customary land.
