When parents separate or divorce, child custody becomes a critical issue. At Muthii W.M & Associates, we are recognized as the best child custody lawyers in Kenya, ensuring that the child’s best interests remain the top priority in custody disputes.

Understanding Child Custody in Kenya
Child custody in Kenya is governed by the Children’s Act, 2022, which prioritizes the welfare of the child in all legal decisions. Custody can be:

✅ Legal Custody – The right to make major decisions about the child’s upbringing.
✅ Physical Custody – Determines where the child lives.
✅ Joint Custody – Shared parental responsibilities between both parents.
✅ Sole Custody – Granted when one parent is deemed unfit or unable to care for the child.

Factors Courts Consider in Child Custody Cases
The court considers several factors before granting custody:

✔ Child’s Best Interests – The child's safety, education, and emotional well-being.
✔ Parental Fitness – The mental, physical, and financial ability of each parent.
✔ Child’s Age – Courts often favor the mother for children under 10 unless proven unfit.
✔ Existing Parent-Child Relationship – The level of involvement of each parent.
✔ Child’s Wishes – If the child is old enough to express a preference.

Adoption Process in Kenya – Step-by-Step Guide
Adopting a child in Kenya is a legal process governed by the Children's Act, 2022, ensuring that the best interests of the child are upheld. Below is a step-by-step guide to help you understand the adoption process in Kenya.

1️⃣ Eligibility to Adopt
To adopt a child in Kenya, you must meet the following criteria:

✅ Be at least 25 years old and at least 21 years older than the child.
✅ Be under 65 years old at the time of adoption.
✅ Have legal capacity and be mentally and physically fit.
✅ Be a Kenyan citizen or a foreigner who has lived in Kenya for at least 3 years.
✅ Married couples must adopt jointly unless the court grants an exception.
✅ Single applicants can adopt but may face restrictions when adopting children of the opposite s*x.

2️⃣ Who Can Be Adopted?
A child is eligible for adoption if:

✔ They are abandoned, orphaned, or placed under government care.
✔ The biological parents or guardians have voluntarily given consent (except in cases of abandonment).
✔ The child is under 18 years old.

3️⃣ Pre-Adoption Assessment
Prospective adoptive parents must undergo a home study and assessment by a registered adoption society such as the Little Angels Network or Kenya Children's Home.
The adoption agency evaluates the applicant’s financial, emotional, and social suitability.
A three-month fostering period is required before proceeding with legal adoption.
4️⃣ Filing for Adoption in Court
The adoptive parents file an adoption petition in the High Court of Kenya.
The court appoints a guardian ad litem (a legal representative for the child) to ensure the child’s best interests are protected.
A Children’s Officer from the Department of Children’s Services conducts investigations and submits a report to the court.
5️⃣ Court Hearing & Issuance of Adoption Order
The court reviews the reports and hears testimonies from the adoptive parents, guardian ad litem, and children’s officers.
If the court is satisfied, it issues an Adoption Order, making the adoptive parents the legal parents of the child.
A new birth certificate is issued with the adoptive parents’ names.
6️⃣ Post-Adoption Support
The adoptive family may receive post-adoption counseling and follow-ups to ensure the child's well-being.
The child is granted full inheritance rights as a biological child.

The Divorce Process in Kenya
1️⃣ Grounds for Divorce – Under Kenyan law, valid reasons include adultery, cruelty, desertion, irretrievable breakdown of the marriage, and mental illness.

2️⃣ Filing a Petition – The spouse seeking divorce (petitioner) files a formal request with the court, stating the grounds for the divorce.

3️⃣ Serving the Other Party – The petition is served to the other spouse (respondent), who has the right to respond.

4️⃣ Court Proceedings & Mediation – If uncontested, the divorce can be finalized quickly. In contested cases, the court may recommend mediation or require hearings.
