Do's while buying land
1. Conduct a search
An official search is very important as it shows who the registered owner is, the size, whether leasehold or absolute, if there are any encumbrance such as a court matter, charges, cautions, caveats etc.

-It is advisable to do the search independently through your advocate as it is a very important step towards conducting your due diligence.

-If the document of ownership is a share certificate, a search will also be conducted in the offices of the company where the shares are held.

2. Physical visit
Visit the land parcel physically. Make sure the land is as described, check the beacons. If there is a neighbor, it would help to talk to them to see if they know the owner and to get any info they might have concerning the property such as suspicious activities that have observed.

3. Sale agreement
Your advocate will draft a sale agreement when you are satisfied that due diligence has been conducted and the property is proper.

4. Completion documents
The vendor will obtain completion documents that is;
Land Consent Board Consent
Spousal Consent or exception to it if not married
Rates clearance certificate (plus rent if leasehold)
Sign transfer forms

After completion, the purchaser's advocate can now register the transfer to obtain a title in the purchaser's name.

Be careful while transacting to avoid falling a victim of fraud or buying land belonging to a deceased person without your knowledge. Always involve an advocate from the onset.
