Your employer dismissed you. No reasons. No hearing. No warning. Under Kenyan law that may already be unlawful. Section 45 of the Employment Act places the burden of proof squarely on the employer.

They must prove the reason was valid, fair, and that proper procedure was followed. Fail on any one of those, and the termination is unfair.

Can your employer fire you even if you committed misconduct? In Kenya, the answer is yes. But only if they followed the right process.

In Khasiani v Teachers Service Commission [2024], the Employment and Labour Relations Court upheld the dismissal of a Senior HR Officer implicated in a teacher bribery scheme not simply because he was guilty, but because the TSC did everything by the book: written allegations, show cause letter, written response, investigation interview, formal interdiction.

Here's the lesson for employers and employees alike: procedure is everything. Under Kenya's Employment Act 2007, even the most justified dismissal can be overturned if the right steps were skipped. And even in the most serious misconduct cases, employees retain the right to a fair hearing.
