🧵 DID YOU KNOW? 🧵

The HIV and AIDS Prevention and Control Act (HAPCA) Can Put MILLIONS in Your Pocket If Your Rights Are Violated.

Most Kenyans don’t know that HAPCA isn’t just about policy-it’s a powerful legal weapon that has compensated ordinary citizens with life-changing sums.

📌 CASE IN POINT: PRJ v Kenya Defence Forces

A young recruit reported to KDF Recruit Training School in Eldoret, ready to serve his country. Instead of a salute, he got humiliation.

🔹 He was tested for HIV without his knowledge or consent.
🔹 No pre-test or post-test counselling was provided.
🔹 His HIV-positive status was publicly announced by a KDF officer.
🔹 He was immediately dismissed and stigmatized.

His words to the Tribunal: “I had no idea about my status. The results were never disclosed to me privately.”

⚖️ THE VERDICT?
The HIV & AIDS Tribunal awarded him KSh 1,050,000 in compensation.

Breakdown:
➖ KSh 400,000 – No informed consent
➖ KSh 250,000 – No counselling
➖ KSh 400,000 – Discrimination based on HIV status

🚨 Why This Matters to YOU:
HAPCA applies to EVERYONE—employers, hospitals, schools, insurers, and even the military. If your HIV status is exposed without consent, or if you are tested without counselling before and after, you are entitled to damages.

Yet many victims suffer in silence, not knowing the law is on their side.

📞 Have you or someone you know faced HIV-related discrimination or unauthorized testing?
