The consulate asks for a mountain of paperwork. The judge asks one question: is the line proven?

In this clip from Episode 5 of The Aprigliano Brief, Avv. Aprigliano explains the difference between the two approaches.

At the consulate, you’re often asked for an enormous file: certificates, translations, apostilles, rectifications, even documents that don’t change the story of your lineage.

In court, the judge looks at the substance: is this person really your ancestor, is the line of descent proven, was Italian citizenship passed down to you? In many cases, that means you don’t need all the documents the consulate requires.

Born Italian. Retroactively considered never to have been. The EU Court has the final word.

The 2025 Tajani Decree is retroactive, Italy’s own Constitutional Court said so. Article 3-bis reaches people born before the reform and considers them as having “never acquired” Italian citizenship, even though under the previous rules citizenship by descent was acquired at birth.

Two people born on the same day, under the same citizenship law, can now face two completely different legal outcomes, based on a deadline that didn’t exist when it passed.

In this article, Avv. Aprigliano breaks down the retroactivity problem at the heart of the Tajani Decree: what the Constitutional Court actually said, why Professor Grosso called it a “truffa delle etichette”, a fraud of labels, and why the question is now before the Court of Justice of the EU in Case C-816/26, Picuso.

⚖️ The CJEU could uphold the mechanism, reject it, or require safeguards.

📋 Waiting for Luxembourg gives certainty. Filing now means having a pending case when the ruling arrives.

Neither choice is without risk.

You've heard the stories at Sunday dinner. But do you know what the records say?

In this clip from Episode 5 of The Aprigliano Brief, Avv. Aprigliano explains the first step when the consulate route is no longer an option: building the legal file.

The goal isn't to pack a box with every possible document, it's to clearly prove to the judge that citizenship was passed down the family line, generation after generation, without interruption.

Thanksgiving in Canada is a moment to pause and give thanks — for family, community, and the journeys that brought us here.

For many Italo-Canadian families, this holiday reflects a deeper story: Italian roots, Canadian opportunity, and traditions passed down across generations. From shared meals to family stories, heritage continues to connect the past with the present.

Dual identity isn’t about choosing one culture over another — it’s about honoring both.

What Italian traditions does your family keep alive in Canada?

✨ Cin cin! [tʃin ˈtʃin] ✨

This is the Italian way to say “Cheers!” when making a toast. It’s commonly said while clinking glasses before taking a drink, whether you’re celebrating a special occasion or simply enjoying good company.

Example:
“Cin cin! To a wonderful evening!” (Cheers! To a wonderful evening!)

It’s the Italian way of raising a glass, sharing a moment, and celebrating together.
Ever raised a glass to celebrate with friends? That’s Cin cin! 👇

Having all your documents doesn't mean your case is ready.

We know how much work went into that folder. The birth certificates, the apostilles, the translations. And yet, a complete genealogy is not a complete court case.

Your strongest citizenship line has to be assessed first. Only then do you know which documents your case actually needs, and what evidence supports the arguments unique to you. The legal strategy decides the documents. Not the other way around.

Being ready doesn't mean having papers. It means having a case.

Comment ITALY and let's find out if yours is truly ready. 🇮🇹

What happens when waiting stops being just an inconvenience — and starts affecting your citizenship process?

For many applicants, the real question isn’t how many more times to refresh Prenot@mi. It’s whether an excessive consular delay could open the door to a different legal path.

Not every case is the same, and going to court isn’t automatically the right solution. But understanding your options can help you decide what makes sense for your situation.

Everyone wants the passport, the EU rights, the future for their kids. It all starts with one step: recognition.

If it's in your bloodline, you're already Italian, it just has to be made official. How your case is built decides how smoothly that happens.
