Earlier this week we covered what happened to UK litigation funding in 2023 - and why the sector now has a rescue plan.

But the more important question for investors in Asia and the Middle East is: why does this matter right now specifically?

The answer is in the numbers. Oil transiting the Strait of Hormuz - the waterway carrying around 80% of Asia's petroleum imports - has fallen to roughly 8% of normal volume. The energy disruption is not isolated. It is flowing through equities, currencies, and bonds across the region.

In 2023, the UK Supreme Court effectively froze an entire investment sector overnight.

Litigation funding - where investors finance legal claims in return for a share of the proceeds - had been a growing, non-correlated asset class for over a decade. Then a ruling involving truck manufacturer PACCAR changed the legal classification of funding agreements, making most of them unenforceable.

Deal flow collapsed. Funders restructured contracts. New cases stalled.

The UK government has now confirmed it will legislate to reverse the ruling. A bill is in the House of Lords. The sector has its rescue plan - and the pipeline of funded claims is beginning to reopen.

For expat investors in Singapore, Hong Kong, and the UAE, the timing is significant.

Problem one: private credit positions that were meant to exit in 2023 or 2024 are still locked. Loan defaults, secondary market discounts, and fund-level restrictions have extended holding periods well beyond what was originally communicated.

Problem two: when the exit eventually arrives, the capital enters a correspondent banking chain that is slower and more compliance-intensive than at any point in recent memory. What emerges from the fund does not immediately become usable capital. It waits.

The banking system is working exactly as regulators intended.
That does not mean it is working for you.

AML reforms enacted across the EU, UK, Singapore, and the UAE in 2025 and 2026 have fundamentally changed how banks process cross-border transactions. Controls that once operated in the background are now active gatekeepers. Legitimate transfers are being flagged, delayed, and in some cases refused - not because of any wrongdoing, but because compliance systems are calibrated for caution.

The FSB's own 2025 data confirms the problem. Only 25.6 per cent of cross-border wholesale payments to Asia-Pacific are credited within one hour. For the Middle East, it is 32.3 per cent.

In March 2026, Apollo Global Management capped withdrawals from a $15 billion private credit fund.

Blue Owl has permanently halted redemptions from its first retail debt vehicle.
Over $11.7 billion in withdrawal requests have been submitted across the sector's major funds. Only 66 per cent has been returned.

This is not a market event. It is a structural reckoning.
