Recently, the Allahabad High Court came down heavily on the criminal prosecution of an advocate for acts performed while representing a client, observing that such action strikes at the very foundation of the legal profession and the constitutional right to legal assistance.
The Court quashed the FIR, charge-sheet, and cognizance order against the lawyer, holding that an advocate cannot be treated as a conspirator merely for adopting a particular legal course on behalf of a client.
