TRUE REFORMs For India (Change in Election Process) (Empowering NOTA- way to eradicate blemish Politicians from reaching parliament)-

In 2010-11, I was fighting against corruption of Congress, was a part of India against corruption (Annaji's movement to bring Lokpal). There was a crisis India was facing in the leadership of Manmohan Singh. There was a dirty mindset of politicians. I was looking for change in government and bring Modi in power. We brought Modi in power with lots of expectations and hopes.

Now, 15 years down the line, I don't see much change. There is still dirty mindset of politicians. There is still corruption, with that we r now also witnessing rise in crimes, loot of common man, economic offences, misuse of government agencies and so on. The mindset of common man has changed. Emotions and bonding have been replaced with materialism and greed. I am again looking for change. But this time, I don't want to change government.

I want to change the election process (by strengthening the democracy), wherein NOTA ("None Of The Above") is empowered and given teeth. If NOTA is elected by the majority in a constituency, then all the political candidates standing in that constituency automatically get suspended because the people have rejected them. And re-election takes place with new candidates of each political party. Until we get clean/good new candidates, people will keep rejecting and political parties will have to bear the cost of re-election and bad candidates keep getting disqualified/suspended/ rejected by the people. That's how only Good people will come in power and parliament will be cleaned.

At present, citizens r asked to elect from candidates/ politicians (many of them may be accused of crimes or have criminal records or are incompetent). Tickets are many times given to greedy people at times having criminal records or often incompetent (I call them "Blemish"). Then citizens have to elect from one such Blemish to rule the citizens and their constituency and loot them for next 5 years. Why should we elect Blemish candidates of any Political Party for our nation? That's the main problem. If required, we may have to collectively resort to the peaceful protests to make changes in this election process. It was a part of our Annaji's movement of India Against Corruption.

But somehow political powers then made false promises to bring NOTA with such power but never brought. They brought the NOTA but without the teeth wherein if NOTA comes in majority, it becomes pointless/ ignored and the next candidate who has got highest vote gets elected. That weakened the democracy. That's how they deprived people of India from effectively exercising their democratic rights. Even the BJP who then supported Annaji's movement never brought this change in NOTA. I am not looking for any leader of existing political parties who are Blemish to survive in our Parliament.

If we bring this reform in the election process, there will be big reform in India because mostly Good people (and not Blemish) will reach parliament thru election process. That would be democracy in the true sense. If Good people reach parliament, the powers shall be better used, better laws will be made with a better justice systems, and better reforms can be implemented from top to bottom.

Let's Make India Better Democratic Again, the first and the most significant step for the Reform.

In my view economic offices and systemic economic frauds (against common man and middle class) have substantially increased in past one decade and IBC (brought by Modi government) is one of the medium of doing the same in a legal way. Since I am in this field, I witness the same everyday. I am saying this with strong conviction.

Will--

Today I was working on a matter where the father had made a Will and on father's death, the Will was challenged by a daughter just because she got little less share under the Will as compared to her share under personal laws. Probably she was not given share in father'a flat. Ofcourse the networth was in crores and flat was also in a renowned location of town side. So it's bound to be. Once such Will is opposed and gets converted into testamentary suit, the inheritance distribution remains in abeyance for 20-25 years and none of the beneficiaries or heirs get their entitled shares distributed till these things r resolved. No one can enjoy the inheritance. I feel sad when the heirs fight for the properties of parents. To overcome this issue, I have developed my very unique skill of drafting the Will which i call it Customised Will. Way different from a Simple Will which we usually draft.

My today's drafting of reply to opposed Will reminded me of my drafting of Customised Will, where in we take so many extra precautions and evidences while drafting the Will (in addition to normal/usual precautions most of the lawyers take like medical certificate from doctor/physician/neuro surgeon, lawyer's witness, notarisation and registration of Will, initial/signature on each page etc) so that Will can not be challenged or opposed. It is one of my finest and unique service for the citizens of our nation. Principally, legally and morally this is to ensure that the last wish of the Testator Will maker can always be honoured irrespective of any one having malice to oppose the Will.

Probably in India, apart from me, very few lawyers would have such skill to get the Will executed in such a fine way that it becomes difficult to challenge or almost impossible to challenge it.. I am not aware of any lawyer in India with such skill which I have developed with my unique knowledge and skills. Though I have remained very vocal about my this unique way of drafting and executing such Customised Will in many profesional institutes while delivering my lectures/ teachings (so that my skills can be passed on to the next generation and more and more people of our nation can benefit from it) but I don't know if any one have actually practised and implemented it even amongst my students.

Most of the time such Customised Will are prepared by us only for businessman or where high stake properties are involved or where there is apparent possibility of dispute amongst the heirs. The ex*****on process itself take about 1.5 hours to 2 hours. But it's one of the most unique service which we professionally provide. And I myself sign as a Witness in such Will (being Advocate & Solicitor) which is also one of the way to protect my drafted Will.
