ON January 12, 2022, the Supreme Court of India, in Vasudha Sethi vs. Kiran V. Bhaskar, ruled that the child’s welfare constitutes the sole criteria in deciding the issue regarding custody of the minor child and the issue of repatriation of the child to the native country. The Court noted that parental rights are irrelevant here. The decision was rendered by a division bench of Justices Abhay S. Oka and Ajay Rastogi on an appeal filed by the mother of a minor child taking exception to a decision of the Punjab and Haryana High Court

In an important development, a Varanasi Court was told today that the court-appointed commissioner has found Shiva Linga inside the Gyanvapi Mosque premises. Pursuant to this, the Court has ordered to seal the place/area concerned.

The order reads as-
" The District Magistrate, Varanasi is ordered to immediately seal the place where the Shiva linga is found and the entry of any person is prohibited in the sealed place".

The Bombay High Court held that mere refusal to marry a woman after a long relationship would not constitute the offence of 'cheating' under section 417 of the Indian Penal Code if there is no evidence of fraudulent misrepresentation of promise of marriage for s*x.

Alcohol Level :: Fines Penalties And / Or Jail as of 2020

Updated Year 2020 : First time Offender if caught under influence of alcohol or any type of drug with (30 Mg per 100 ML) as measured positive in breathalyzer will have to pay a fine of Rs.10,000. The penalties has an optional imprisonment of upto 6 months (Decided by authorities). Second time & Subsequent offender if measured positive above the permissible limits ha to pay a fine of Rs.20,000 (and / or Jail up to 2 years).

'Live-in-relationship'
Tussle between legal right and moral values.

In S. Khushboo v. Kanniammal, the Hon'ble Supreme Court held that a living relationship comes within the ambit of the right to life under Article 21 of the Constitution of India. The Court further held that live-in relationships are permissible.

It was held that:-

1. Such women is entitled to protection under D.V Act, 2005.

2. Such women can claim maintenance under section 125 Cr.p.c.

3. Child born in live in relationship is entitled to inheritance of father's property.
