Supreme Court Quashes Copyright Infringement Case Against Director Sujoy Ghosh Over ‘Kahani 2’ Script
The Supreme Court has quashed criminal proceedings against director Sujoy Ghosh in a case alleging that his film Kahaani 2 was based on a stolen script. A bench of Justices PS Narasimha and Alok Aradhe set aside the Jharkhand High Court order and the CJM's summoning order, noting that the magistrate had acted mechanically without comparing the scripts or establishing a prima facie case. The Supreme Court has held that the mere dishonour of a post dated cheque cannot by itself establish dishonest or fraudulent intention necessary to prosecute a person for cheating under Section 420 IPC. A bench of Justices PS Narasimha and Manoj Misra clarified that criminal liability requires proof that the accused possessed fraudulent intent at the inception of the transaction, not inferred from later failure to repay. The Supreme Court has held that a foreign divorce decree granted on the ground of irretrievable breakdown of marriage is not enforceable in India, as this ground is not recognised under the Hindu Marriage Act (HMA), 1955. The Court held the foreign decree inconclusive, but exercising powers under Article 142, formally dissolved the marriage due to 18 years of separation.
