Facts of the Case

Event: A Rakhi was tied by a neighbour girl (“crush”) onto the wrist of a minor male (“little sardar”) without his prior informed consent.

Disclosure: The male was informed post facto that this act signifies the establishment of a brother–sister relation

Objection: The male contends that the relation is invalid under Life Procedure Code provisions.

Relevant Provisions of LPC
LPC-134(1): Where a Rakhi is tied between non-blood relations, full informed consent of both parties must be obtained prior to the act.
LPC-134(2): If either party is below 18 years, the act shall be deemed tentative and subject to confirmation or repudiation upon attainment of majority.

Application to Present Facts
1. Lack of Informed Consent
• The Rakhi was tied without disclosure of its binding consequences.
• Consent obtained retrospectively is vitiated under LPC-134(1).
2. Minority of Male Individual
• At the time of the act, the male was a minor (“little sardar”).
• As per LPC-134(2), any such ritualistic bond is subject to future confirmation.
• Thus, no permanent “brother–sister” legal fiction arises until he attains majority.
3. Intention of the Female Individual
• The act may amount to constructive fraud on emotions if performed to block romantic prospects under guise of siblinghood.

Opinion
• The “brother–sister relation” claimed in this case is invalid on grounds of:
1. Absence of informed consent (LPC-134(1)); and
2. Minority status of the male (LPC-134(2)).
• The male, upon attaining majority, may repudiate the Rakhi-bond and restore original neighbour-crush status.
