బెంగళూరు : కుమారుడి ఆస్తిలో తల్లికి కూడా హక్కు ఉంటుందని, హిందూ వారసత్వ చట్టం ప్రకారం చనిపోయిన కొడుకు ఆస్తికి తల్లి మొదటి తరగతి వారసుడని హైకోర్టు కీలక ఆదేశాలు జారీ చేసింది.
భర్త బతికే ఉన్నా.. పిత్రార్జిత ఆస్తిలో కుమారుడికి రావాల్సిన ఆస్తిలో వాటా పొందవచ్చని హైకోర్టు కీలక ఉత్తర్వులు ఇచ్చింది.

చనిపోయిన కుమారుడి ఆస్తిలో వాటా పొందే హక్కు తల్లికి లేదని సబార్డినేట్ కోర్టు ఇచ్చిన ఉత్తర్వులను సవాల్ చేస్తూ సుశీలమ్మ దాఖలు చేసిన రెండో అప్పీల్‌ను హైకోర్టు న్యాయమూర్తి జస్టిస్ హెచ్. సందేశ్ నేతృత్వంలోని సింగిల్ మెంబర్ బెంచ్ తీర్పు వెలువరించింది.

అయితే దరఖాస్తు విచారణలో ఉండగానే సుశీలమ్మ కూడా మృతి చెందింది. సుశీలమ్మను పిటిషన్‌లో పార్టీగా చేయడంతో, మరణించిన కొడుకు యొక్క మొదటి తరగతిలో ఆమె వారసురాలు అవుతుంది. మృతుడికి తల్లి, భార్య మరియు కుమారుడు ఉన్నారు మరియు సుశీలమ్మ హిందూ అవిభాజ్య కుటుంబంలో మొదటి తరగతి వారసురాలు. ఆ విధంగా కొడుకు ఆస్తిలో వారికి వాటా దక్కుతుంది. మొదటి అప్పీల్ కోర్టు చర్య లోపభూయిష్టంగా ఉందని హైకోర్టు పేర్కొంది.

సుశీలం భర్త బతికే ఉన్నాడు. కొడుకు మరణానంతరం సుశీలమ్మ కొడుకు మొదటి తరగతి వారసురాలి అవుతుంది. దీనిని ట్రయల్ కోర్టు పరిగణనలోకి తీసుకోలేదు. అలాగే తల్లిని మంత్రసానిగా పరిగణించరు. ఉమ్మడి ఆస్తిలో ఆమె వారసత్వంగా లేదా వాటా క్లెయిమ్ చేయరాదని తప్పుగా ఆదేశించిందని హైకోర్టు పేర్కొంది.

సుశీలం కుమారుడి భార్య, కుమారుడి పూర్వీకుల ఆస్తిలో వాటా కోరుతూ ట్రయల్ కోర్టు దాఖలు చేసిన పిటిషన్‌పై ట్రయల్ కోర్టు మరియు మొదటి అప్పీల్ కోర్టులు అతనిని పార్టీగా పరిగణించలేదు, వారి ఆర్డర్ చట్టవిరుద్ధం మరియు అన్యాయం. మృతుడికి నేనే తల్లినని, తన ఆస్తిలో తనకు వాటా ఇవ్వాలని శశిలమ్మ హైకోర్టును ఆశ్రయించారు. హైకోర్టు ట్రయల్ కోర్టు ఆదేశాలను సవరించి తల్లికి ఆస్తిని పంచింది.

Women filing false POCSO, SC/ST Act cases to grab money from the State, ruin the image of innocent people: Allahabad High Court
While granting anticipatory bail to a r**e accused, the Court called for criminal action to be taken against the complainant is the case is found to be false.
The Allahabad High Court on Thursday frowned upon the apparent trend of women filing false complaints under the Protection of Children from Sexual Offences Act (POCSO Act) and the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 (SC/ST Act) to grab money from the State.
