A Wife's Culinary Woes Don't Equal Cruelty, Rules Bombay High Court
A Bombay High Court ruling has taken the heat out of kitchen arguments, declaring that comments about a wife's lack of culinary skills don't amount to cruelty under Indian law.

The case involved a woman who filed an FIR against her husband's relatives, accusing them of insulting and taunting her about her cooking abilities. They allegedly mocked her for not knowing how to cook, claiming her parents didn't teach her anything in the kitchen. However, the High Court tossed out the complaint, deeming such criticisms merely "petty quarrels" that don't qualify as cruelty under Section 498A of the Indian Penal Code.

The judges stressed that the law targets serious harm, not culinary critiques. To prove cruelty, there must be more than just verbal digs – think threats, harassment, or behavior that creates a dangerous or oppressive environment for the wife.

So, while burnt offerings might spark some tension, they won't land your in-laws in hot water unless they're accompanied by more sinister ingredients. This case serves as a reminder that healthy communication and understanding, not legal action, are the key spices for a happy marriage.

Section 4(f) of BNS has introduced a new 6th type of punishment – Community service

To reduce the burden on jails, community service has been included in BNS as a punishment for the first time and it is being given legal status. [PIB Press Release, dated 20-12-2023]

BNS prescribes Community Service as punishment for petty offences like non-appearance in response to a proclamation, attempt to commit su***de, to compel or restraint exercise of lawful power of public servant, petty theft on return of theft money, misconduct in public by a drunken person, defamation, etc.

The term β€œcommunity service” is not defined in BNS. However, it is defined by Explanation to section 23 of BNSS to mean the work which the Court may order a convict to perform as a form of punishment that benefits the community, for which he shall not be entitled to any remuneration.

President gives assent to three Criminal Law Amendment Bills

The Bharatiya Nyaya Sanhita, the Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam will replace the Indian Penal Code (IPC), the Code of Criminal Procedure (CrPC) and the Indian Evidence Act.

The three bills were first introduced in Lok Sabha on August 11 as Bharatiya Nyaya Sanhita, the Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Bill before being referred to a parliamentary committee headed by Brij Lal for further examination.

They were passed by the Lok Sabha on December 20 before being passed by the Rajya Sabha on December 21.
