A man who remained in a consensual relationship for nearly one year was later forced to face r@pe charges after the relationship failed and marriage did not happen.
Despite absence of injury marks, lack of specific allegations, and changing statements during investigation, serious criminal proceedings were initiated against him.
The Allahabad High Court ultimately held that refusal to marry after a consensual relationship does not automatically make a man a r@pist, and quashed the FIR, charge-sheet and entire criminal proceedings against him.
