An elderly couple had by mistake entered the First AC coach.

Both looked nervous, with fear on their faces and tears in the mother’s eyes.

When the ticket checker came, I thought he would scold them.

But instead, he looked at the mother kindly and said:

“Don’t worry, mother… you are like a mother to me too. Mistakes happen, it’s okay.”

In that moment, I felt — rules do matter, but kindness matters more.

With just a few gentle words, he turned their fear into comfort and won their hearts.

Sometimes, all it takes to win hearts is empathy.

BHADRA INTERNATIONAL INDIA PVT LTD AND ORS. versus AIRPORTS AUTHORITY OF INDIA

The Delhi High Court recently held that the award cannot be set aside solely on the ground that the appointment of the Arbitrator was illegal in view of section 12(5) of the Arbitration and Conciliation Act (Arbitration Act), when no such objections were raised before the Arbitrator or the court under section 34 of the Arbitration Act.
“The arbitral atmosphere is changing day by day. The prevailing philosophy of the day, so far as arbitration is concerned, is to foster arbitration and maximize resolution of disputes by the arbitral process. Courts are now advisedly cautious while dealing with technical objections to arbitral awards, and it is only when the objection is ex facie fatal, that an arbitral ward ordinarily should be jettisoned. Still less should the Court be inclined to interfere when, in as a case such as this, a party acquiesced to the arbitration proceedings without raising a finger with respect to the authority, jurisdiction or competence of the learned Arbitrator and after suffering an adverse award, belatedly seeks to raise a challenge to the jurisdiction of the Arbitrator to arbitrate.”

Punjab and Haryana High Court bench states “ the first and foremost duty of the husband is to maintain the wife and child. He may beg, borrow or steal.” I disagree with order, let there be humanity also. If there is unemployment and husband is unemployed then a lighter approach may be adopted and time or work may be given to the husband so that there could be a means of livelihood for husband also.
