Under Section 175(4) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), any complaint filed against a public servant for acts done in the discharge of official duties is not maintainable unless the mandatory conditions prescribed under Section 175(3) are strictly complied with. The Supreme Court has clarified that these procedural safeguards are not mere formalities but are essential to protect public servants from frivolous, vexatious, or motivated prosecutions arising out of their official functions. Section 175(3) requires prior compliance, such as giving an opportunity to the public servant or following the prescribed sanction-related procedure, before a court can take cognizance of such complaints. A complaint filed in violation of these conditions is liable to be rejected at the threshold. This provision ensures a balance between accountability of public servants and the need to protect honest officials from unnecessary criminal litigation, thereby upholding the rule of law and administrative efficiency.
