The Open Network for Digital Commerce (ONDC) will publish a draft framework for dispute resolution, as it seeks to boost consumer trust in the ambitious initiative, which is slated to go live later this month.

The online dispute resolution (ODR) will be handled by a third-party agency that will review the digital trail left behind by individual orders and take a call.

Consumers will be able to track the status of complaints, how many are resolved, and will be involved in the final rating of merchants on the network.

ONDC will also record all complaints filed against a particular entity, linked directly to the network-wide reputation index that tabulates percentages of complaints raised, resolved or not resolved, as well as those that consumers may choose to take to consumer courts.

The draft document will be based on the ODR Policy Plan published by an expert committee of the Centre’s public policy think tank Niti Aayog in October 2021.

Why it’s needed: ONDC’s move comes amid a debate on the need for a robust dispute resolution framework if ONDC is to compete effectively against the likes of ecommerce majors Amazon and Flipkart.

“In traditional mediation wherein the parties have to travel long distances to attend the proceedings, ODR saves valuable time and resources. Its promising to witness significant strides being taken towards modernizing mediation - such as utilization of video conferencing to conduct proceedings, software applications to sift through mass volumes of submissions made thereby allowing the Mediator to focus on the most imperative information, and efforts made by the government in its recommendations provided by the NITI Aayog Expert committee on ODR”

Benefits of virtual hearings:

Accessibility

Remote hearings are undoubtedly boosting access to justice by making it easier for participants to appear, particularly in circumstances where parties are unable to attend court due to illness or otherwise.

Efficiency

Remote hearings are logistically more efficient. The judicial system was already experiencing a backlog pre-pandemic, and additional downtime last few years added to the build-up in cases. Virtual hearings provide more flexibility and help reduce delays.

Reduction in travel

In the legal sector, pre-pandemic, travel was a disruptive but necessary part of the industry. There was not only the cost associated with travelling but also the time spent doing so. Whether driving miles across the country for domestic cases or flying internationally, travelling was lost time in productivity.

Cost-saving

Virtual hearings are more cost-efficient than in-person cases, primarily due to travel costs and court hire. A large factor is the cost of staff at court sites and the use of multiple locations in the process.

Carbon footprint

Whether that was global travel pre-pandemic or current domestic travel across the country, hosting a physical hearing can clock up some serious miles through transportation, and this results in high levels of emissions from all parties.

The online dispute resolution in India is at the outset stage and is picking up legal acknowledgment with time. The three mainstays of ODR are convenience, trust, and skill – and it is additionally clear that India as of now has the vital components for presenting a comprehensive structure of technology in dispute resolution measures, to be specific, institutional willingness, ability and to a huge extent, technological capacity. Thus, investing in ODR by adopting new and efficient technology can help India progress towards a better justice system.

ODR is Beneficial For Both Sides

While there is an overarching belief that most companies insert arbitration clauses to hamstring consumers’ ability to bring claims, the truth is many progressive companies are now researching alternatives to court and traditional arbitration, including the use of ODR. Perhaps part of thawing the relationship between consumers and companies is having both parties recognize that while there may be competing interests, searching and implementing new solutions to old problems can benefit both parties. At the end of the day, protracted litigation can sometimes be a strategy, but it rarely results in positive outcomes. As companies embrace the digital age and make it easier for consumers to resolve their claims, they will find that doing so saves everyone involved valuable time, energy, and money.

The Independence Day of India, which is celebrated religiously throughout the Country on the 15th of August every year, holds tremendous ground in the list of national days, since it reminds every Indian about the dawn of a new beginning, the beginning of an era of deliverance from the clutches of British colonialism of more than 200 years.

It was on 15th August 1947 that India was declared independent from British colonialism, and the reins of control were handed over to the leaders of the Country. India's gaining of independence was a tryst with destiny, as the struggle for freedom was a long and tiresome one, witnessing the sacrifices of many freedom fighters, who laid down their lives on the line.

Fortunate are those who are born in free India… Independence Day is the time to remember all those who struggled to get us freedom and gifted us an Independent India.

“It is easy to kill individuals, but you cannot kill the ideas. Great empires crumbled, while the ideas survived.” - Bhagat Singh

We wish you and your loved ones a very Happy Independence Day!

Jai Hind!!! 🇮🇳

06/08/2022

After the introduction of the opt-out mediation model in Italy, it was observed that about 180,000 mediations were initiated.

Out of these, on an average, in almost 50% of the sessions, the parties voluntarily agreed to continue with the full mediation process.

Subsequently, the figures showed that in Italy, for these categories of disputes, the mediations outnumbered the cases in courts- a first for Europe.

Significantly, the institution of cases before the courts witnessed a fall for these disputes, specifically in the case of joint ownership of real estate (by 30%), rental apartments (by 40%), and adverse possession (by 60%).

These numbers make it clear that with the opt-out model, Italy was able to realise the benefits which mediation offers at its full potential and relieve the judiciary’s burden.

The ingredients that have led to a successful Italian model are universal. They hence show promise that if adopted in India, the model could lead to successful resolution of disputes through mediation.
