The Cabinet’s approval to infuse Rs 2,500 crore into National Insurance Company, Oriental Insurance Company and United General Insurance Company, may be a step towards the proposed merger of the three companies, which is at an advanced stage.

NEW DELHI: The Direct Tax Vivaad se Vishwas Bill, 2020 will now cover pending litigation in debt recovery tribunals (DRTs) as well besides those in various courts and tribunals, the Union cabinet said while approving the change to the bill.

“It has been decided to cover disputes pending in DRTs also,” Union minister Prakash Javadekar said after the Cabinet meeting. “Disputes of search and seizure where the recovery is below Rs 5 crore can be taken in this scheme," he added.

Burden of Proof in Cheque Bouncing cases: What Supreme Court held
The Supreme Court on Wednesday made pertinent observations regarding the burden of proof that falls upon opposing parties in a cheque bouncing dispute under the Negotiable Instruments Act, 1881.
A Bench of Justices R Banumathi and AS Bopanna highlighted that once the complainant discharges the initial burden to prove the existence of a legally enforceable debt, it would fall on the defendant to prove that he is innocent.
The defendant may prove his innocence either by showing that there is no debt or by proving that the cheques he issued were supported by sufficient funds.

Possible to identify originators of WhatsApp messages, IIT Madras Professor tells Madras HC:

Challenging the submissions made so far by the messaging platform, a technical expert from the Indian Institute of Technology (IIT) Madras, yesterday told the Madras High Court that it is possible to add an identification tag to WhatsApp messages, and thereby trace the original sender.

The Bench of Justices S Manikumar and Subramonium Prasad was told that it is possible, in a metaphorical sense, to alter the 'preamble' of WhatsApp so that such an identification facility is introduced.

What can attract conviction under Section 498A of Indian Penal Code? Supreme Court answers:-

The Supreme Court reaffirmed that wilful conduct that drives a wife to commit su***de or demand for dowry, both could attract conviction under Section 498A of the Indian Penal Code (IPC).

The Supreme Court observed,

"Conviction under Section 498A IPC is for subjecting a woman to cruelty. Cruelty is explained as any wilful conduct which is likely to drive a woman to commit su***de or to cause grave injury or danger to life, limb or health. Harassment of a woman by unlawful demand of dowry also partakes the character of ‘Cruelty’."

The observations form part of a judgment which was rendered in an appeal filed by one Wasim against a decision of the Delhi High Court which had confirmed his conviction under Section 498A of the IPC.
