Banyak yang salah paham! Apakah semua putusan Pengadilan Negeri terkait Arbitrase bisa diajukan banding ke Mahkamah Agung? 🤔

Ternyata, berdasarkan Pasal 72 UU Arbitrase & APS serta Yurisprudensi MA (Putusan No. 709 B/Pdt.Sus-Arbt/2020), upaya hukum Banding dan Peninjauan Kembali (PK) HANYA BERLAKU jika Pengadilan Negeri mengabulkan pembatalan putusan arbitrase.

Artinya, kalau Pengadilan Negeri MENOLAK permohonan pembatalan, maka pintu upaya hukum otomatis tertutup! Sifatnya langsung final. 🙅‍♂️💼

Banding pun hanya bisa diajukan atas 3 alasan limitatif ini (Pasal 70):
1️⃣ Ada dokumen palsu setelah putusan.
2️⃣ Ditemukan dokumen menentukan yang sengaja disembunyikan lawan.
3️⃣ Putusan diambil dari hasil tipu muslihat.

Dalam regulasi terbaru terkait pengelolaan rumah susun, terdapat perubahan istilah dari “Rapat Umum Anggota (RUA)” menjadi “Musyawarah Anggota”. Meskipun secara substansi tidak terdapat perubahan yang signifikan, perubahan nomenklatur ini menimbulkan perhatian karena peraturan pemerintah masih menggunakan istilah “rapat umum” atau “rapat anggota”.

🟡 Permohonan Banding hanya Berlaku untuk Pembatalan Putusan Arbitrase dalam Yurisprudensi (3) 🟡

⁉️ Apakah putusan pengadilan negeri yang tidak membatalkan putusan arbitrase dapat diajukan banding?

✅ Pasal 72 UU Arbitrase dan APS mengatur bahwa permohonan pembatalan putusan arbitrase diajukan kepada Ketua Pengadilan Negeri.
✅ Terhadap putusan tersebut, permohonan banding dapat diajukan ke Mahkamah Agung.

✅ Namun, Penjelasan Pasal 72 menegaskan bahwa “banding” hanya berlaku untuk pembatalan putusan arbitrase berdasarkan 3 alasan dalam Pasal 70, yaitu:
• adanya dokumen palsu setelah putusan;
• ditemukannya dokumen penting yang disembunyikan; atau
• putusan diambil melalui tipu muslihat salah satu pihak.

‼️ Dalam Putusan No. 465 B/Pdt.Sus-Arbt/2020, Mahkamah Agung menyatakan bahwa terhadap putusan Pengadilan Negeri yang menolak permohonan pembatalan putusan arbitrase tidak tersedia upaya hukum.

✅ Artinya, hanya putusan yang membatalkan putusan arbitrase yang dapat diajukan banding. Jika permohonan pembatalan ditolak, maka tidak tersedia upaya banding.
