On 28 May 2026, Hong Kong's Judiciary announced plans for the Hong Kong International Commercial Court (HKICC), a new specialist branch of the High Court built to handle large, complex, cross-border commercial disputes. Instead of sitting in the general queue of the Court of First Instance, these cases will be heard in a forum designed specifically for them, with experienced judges, tighter case management, and a strong emphasis on digital services. 💻

Non-Compete Clauses, When Your Contract Tries to Control Your Future

Can an employment contract really stop you from joining a competitor years later, even if you signed it on your first day in a junior role?

The Hong Kong District Court decision in Moxie Communications Limited v Lai Cheuk Lok [2024] HKDC 1323 is a reminder that restrictive covenants are not automatically enforceable just because they appear in a signed contract. In that case, the court refused to enforce a two-year non-compete and an indefinite non-solicitation clause against a former junior employee, and dismissed the employer’s claim with indemnity costs.

For employees, it is a useful reminder that broad restrictions may not survive judicial scrutiny. For employers, it shows how overreaching drafting can backfire.
