What Should You Put in a Will? Here’s What Really Matters

Thinking about writing your Will? You might be wondering what you’re actually supposed to include and what extras you can add to make sure everything’s covered.

Here’s what needs to go in:

🔑 Who you are - your full name, confirmation that this is your legal Will
🧑‍⚖️ Who you trust to carry out your wishes (your executors)
💷 Who you want to inherit your money, property, and possessions
✍️ Your signature and two witnesses (who aren't beneficiaries)

But a great Will goes beyond the basics. You can also include:

What Is Intestacy and Why Should You Care?

When someone dies without a Will, it’s called dying intestate. That means their estate and everything they own is distributed according to fixed legal rules, rather than their personal wishes.

Intestacy laws don’t take into account:

Who you’re closest to
Who you live with
Stepchildren or blended families
Promises or verbal agreements
Who needs support most

Instead, your estate is passed down in a strict legal order, starting with spouses or civil partners, then biological children, parents, siblings, and so on. If you’re not married or related by blood, you won’t inherit anything under these rules.

Here’s what that means in real life:

⚠️ Long-term partners are left with nothing
⚠️ Children from previous relationships may miss out

What is a Lasting Power of Attorney (LPA)?

Have you ever thought about what would happen if you couldn’t make decisions for yourself, maybe because of an accident, illness, or condition like dementia? It’s something we all hope never happens, yet planning ahead means you and your family can stay protected.

A Lasting Power of Attorney (LPA) is a legal document that lets you appoint someone you trust to act on your behalf if you lose capacity, in other words, if you're no longer able to make important decisions for yourself.

There are two types of LPA, and they each cover different parts of life:

💳 Property & Financial Affairs LPA
This allows your chosen person (called your attorney) to manage your finances. They can help with things like:

Paying your bills

Managing bank accounts

Collecting pensions or benefits

Buying or selling property

Handling day-to-day money decisions

You can choose whether they act only if you lose capacity, or while you still have it (e.g. if you want help managing things).

❤️ Health & Welfare LPA
This comes into effect only if you lose capacity. It gives your attorney the power to make decisions about:

Your medical treatment

Life-sustaining care

Where you live and who cares for you

Your daily routine (meals, clothes, social care)

This LPA means your family won’t be left guessing or battling systems if something unexpected happens.

👉 You can only set up an LPA while you still have mental capacity, once that’s lost, it’s too late, and your loved ones would need to go through the courts (a long and expensive process).
