UK High Court Upholds Dryrobe’s Trade Mark Rights in D-robe Genericide Battle

The Intellectual Property Enterprise Court (IPEC) has delivered a significant ruling in Dryrobe Limited v Caesr Group Limited, confirming that Dryrobe successfully defended its trade mark against an infringement claim and a counter-claim of genericide.

The defendant argued that 'Dryrobe' had become the generic name for the product category, which would have invalidated the brand's protection. The court firmly rejected this argument.

This case offers essential, practical guidance for any brand achieving "household name" status. It clearly outlines the specific, proactive enforcement steps necessary to:

📅 Major Financial Overhaul: Significant UPC Fee Increase Effective 1 January 2026

The Unified Patent Court ( ) is set to introduce a substantial revision of its Table of Court Fees, applying to all new proceedings filed from 1 January 2026.

These changes, adopted by the Administrative Committee, go beyond routine inflation adjustments: they impose dramatic percentage increases and create a sharper financial differentiation between first-instance proceedings and appeals.

🔹 The fixed fee for core infringement actions rises by 33% (from €11,000 to €14,600).

🔹 The fee for preservation of evidence is increasing by over 1,300% (from €350 to €5,000).

Patent litigants should reassess their budgeting and procedural strategies to prepare for the new cost regime. Filing by December 31, 2025, is now a key strategic consideration.

UK IPO Fee Rises Proposed for 2026: Strategic Portfolio Review Now Essential

The Intellectual Property Office UK has announced its intention to increase official fees for patents, trade marks, and designs, with an anticipated effective date of 1st April 2026.

These proposed increases, averaging 25% across all rights, are still subject to parliamentary approval. However, given the significance (it's the first trade mark fee review since 1998), proactive planning is critical.
