One of the biggest myths in family law? Mothers automatically get custody after separation.

Not true. And the law doesn't even use "custody" anymore, it's called "child arrangements."

What actually happens:
There's no assumption one parent gets more time. Courts start from the position that kids benefit from meaningful time with both parents unless there's a welfare issue.

What decides it:
The child's best interests, their needs, each parent's ability to meet them, the child's wishes (if age-appropriate), and any risk of harm.

The ideal outcome:
Parents sorting it themselves. Courts only step in when there's genuine dispute or safety concerns.

Navigating child arrangements? We help families resolve this with clarity and care.

At Shawstone Associates, we work with people facing some of the toughest situations in immigration law, asylum cases, deportation threats, detention, and human rights claims where everything's on the line.

We handle the full range: asylum applications, human rights challenges, fighting detention and removal orders, supporting unaccompanied minors, securing bail, appealing deportations, and making family life claims for people with deep UK ties.

We also take on complex medical cases under Article 3, where sending someone back would mean losing access to life-saving treatment.

Every case is different. Every person's circumstances are unique. But our approach stays the same: we prepare thoroughly, communicate clearly, and advocate hard for clients going through what might be the most difficult legal battle of their lives.

If you or someone you know is facing removal, detention, or needs protection in the UK, get in touch.

The biggest change? It's not what's new, it's what courts can't accept anymore.

For years, Non-Molestation Orders had vague language. Victims didn't know what protection they had. Respondents didn't know what was prohibited. Courts handed out urgent orders without checking the urgency. Processing times were inconsistent.

Result? Victims waiting weeks. Respondents with unclear restrictions couldn't follow them.
The 2026 guidance fixes that. Courts must act fast, not when convenient. Orders need solid evidence. Wording must be specific.

Why it matters: Protective orders only work if they're quick, clear, and enforceable. Delays put people at risk. Vague language creates problems. Inconsistent rules undermine trust.

A Lasting Power of Attorney basically gives someone the legal right to make decisions about your health or your money if you can't do it yourself. That's huge. And while most people who take on that responsibility do the right thing, not everyone does.

That's why the Office of the Public Guardian exists. It's not just there to process forms and call it a day. It's there to make sure the people who've been given that kind of power aren't taking advantage. If something doesn't look right, they step in. They investigate. They make sure vulnerable people aren't being exploited by the very people who are supposed to protect them.

If you're thinking about setting up an LPA or you're helping someone through it, we're here to help. Contact us.

Most employers know they're supposed to check right to work, but a lot of them treat it like a formality that only applies "sometimes" or to "certain people." That's where the trouble starts.

The law doesn't care if you forgot, didn't think it applied to this role, or assumed someone was fine because they've been here for years. If you hire someone without checking and they don't have the right to work, the penalty lands on you, not them. And it's not a warning or a slap on the wrist. It's tens of thousands of pounds, potential prosecution, and your business name on a public list.

We provide right-to-work training and audit support for employers, contact us.

The BN(O) visa route is designed for Hong Kong British National (Overseas) status holders and their families who want to move to the UK with a clear path to permanence.

So, who qualifies?
You need to be 18 or older and hold BNO status registered before Hong Kong’s 1997 handover. If you were born on or after 1 July 1997, you can qualify as a child of a BNO holder. Your permanent home needs to be in Hong Kong, or the UK/British Isles if applying from within. Close family like spouses, partners, and kids under 18 can join if they meet the relationship requirements.

What does it give you?
You can apply for either 2.5 or 5 years initially and extend after that. There's no minimum salary or English test upfront. Applications are processed digitally via eVisa, with decisions usually taking around six weeks.

If you're planning the move or helping someone navigate it contact us for expert advice.

Most people think immigration status is simple: you've either got it or you don't. But the EU Settlement Scheme works differently, with two categories where one expires and the other doesn't.

Pre-Settled and Settled Status might sound like minor variations, but they're not. One gives you a few years to figure things out. The other gives you indefinite leave to remain. And here's the part that catches people out: the upgrade from Pre-Settled to Settled doesn't happen automatically. You have to apply once you're eligible. Miss that window, and you could lose your right to stay.

Lost your British citizenship? You might actually be able to get it back.

A lot of people don't realise this, but if you renounce British citizenship or lost it years ago because of old nationality laws, there are legal routes that let you reclaim it. It's not automatic, and not everyone qualifies, but it's worth checking if you might.

We help people figure out if they're eligible and guide them through the application. If you're not sure where you stand, get in touch with us; we can help.

Still hearing about the Tier 1 Investor Visa?
The UK shut down the Tier 1 Investor route 4 years ago as part of reforms to tighten up investor immigration pathways, and new applications haven't been accepted since.

For anyone who was considering the investor route or is looking for similar options now, there are alternatives. The Global Talent visa and Innovator Founder visa both work for high-net-worth individuals and entrepreneurs.

If you’re not sure which route fits your situation, or need help with your existing visa? We're here to walk you through it, contact us.

"Both routes lead to the same place, so it doesn't really matter which one you're on."
Nope.

This is one of the biggest misconceptions in UK immigration. Yes, both the 5-year and 10-year routes eventually get you Indefinite Leave to Remain. But that's where the similarities stop.

Need clarity? Contact us. We help people navigate their settlement pathways every day.
