Your family does not have the final say over your medical care without an LPA.

As an estate planner, I see this misunderstanding all the time. People assume that if a medical crisis happens, their spouse or children automatically get to decide on their treatment, pain management, and care settings.

In reality, if you lose mental capacity without a Health and Welfare Lasting Power of Attorney (LPA), the legal right to make those choices is stripped away from your family. While doctors are legally required to consult your loved ones, the medical team holds the ultimate decision making power under a “best interests assessment.”

An LPA changes everything. It gives the people who actually know you best the immediate legal authority to step into your shoes. They get the final say on your care plans, medication, and living arrangements the moment you cannot, ensuring your wishes are followed without delay.

Don’t wait for a medical emergency to find out your family’s hands are tied.

One of the hardest things I see in my job isn’t death.

It’s what happens afterwards.

I sit on sofas with people who have just lost someone they love, surrounded by a lifetime of someone else’s things, trying to piece together what they would have wanted and where they’re even supposed to begin.

They’re grieving, but they’re also searching. Making decisions. Second-guessing themselves.

And the person they desperately want to ask is no longer there.

That’s why I don’t see planning as being for death 🕊️

I see it as taking care of the people who have to carry on living.

So what can you actually do instead?

You don’t have to choose between looking after your spouse or partner and protecting something for your children.

Depending on your circumstances, your Will could include a life interest trust or discretionary trust to give you more control over what happens longer term.

Save this or send it to someone with children who needs to think about this.

Because leaving everything outright to a partner can mean losing control over where those assets eventually end up.

Relationships change. Families fall out. Circumstances change.

For blended families, a Life Interest Trust (estate value dependent) or Discretionary Trust may be worth considering as part of the planning.

The aim? Provide for your partner without forgetting who you ultimately want to inherit.
