From April 2020 the rules for engaging individuals through personal service companies (PSCs) are changing. The responsibility for determining whether the off-payroll working rules apply will move to the organisation receiving an individual’s services.

The HMRC's advice is aimed to help organisations prepare before the changes come in.

How to prepare

Look at your current workforce (including those engaged through agencies and other intermediaries) to identify those individuals who are supplying their services through PSCs.

Determine if the off-payroll rules apply for any contracts that will extend beyond April 2020. You can use HMRC’s Check Employment Status for Tax service to do this.

Start talking to your contractors about whether the off-payroll rules apply to their role.

Put processes in place to determine if the off-payroll rules apply to future engagements. These might include who in your organisation should make a determination and how payments will be made to contractors within the off-payroll rules.

What you know about Making Tax Digital (MTD)
u run a VAT-registered business with a taxable turnover above the VAT registration threshold (currently £85,000) you are required to keep digital VAT business records and send returns using Making Tax Digital (MTD)-compatible software. The vast majority of businesses will need to do this for VAT periods starting on or after 1 April 2019. Businesses with a taxable turnover below the VAT threshold can also sign up for MTD for VAT voluntarily.

If you have an accountant, you should speak to them to find out about an appropriate software package, if you already use accounting or record keeping software you should also speak to your software provider to find out when it will be updated for MTD.

You’ll still need to file a Company Tax Return online - this will show HMRC that your company is dormant.

HMRC won’t send you another ‘notice to deliver a Company Tax Return’ once they make your company dormant.

Limited companies
You don’t need to pay Corporation Tax or file another Company Tax Return once you’ve told HMRC your company is dormant.

You must still file annual accounts and a confirmation statement (previously annual return) - exactly what you must do depends on if you’re dormant for Companies House.
