我明明有理由趕租客,點解法庭都唔批?
好多業主就係衰喺文件唔齊!

而家 Section 21 已經冇咗,政府正式取消 no-fault eviction。
即係話,以前最簡單趕租客嘅方法,已經行唔通。
依家你要趕租客,只可以行 Section 8。

但問題係——
就算租客欠租、破壞你間屋、只要你少咗其中一份關鍵文件,法庭都可以即刻踢你個case出局。

而家法庭排期平均21個星期。

咁到底要有邊7份文件?

第一,Gas Safety Certificate
第二,EICR 電力安全報告
第三,EPC 能源效益證書
第四,Smoke Alarm 同 Carbon Monoxide Alarm 合規
第五,Deposit Protection 文件
第六,Right to Rent 檢查
第七,2026年5月31前你要俾現有租客嘅政府資訊文件 Information Sheet或者2026年5月1號前你已經俾咗租客嗰份How to Rent Guide

少一份,都可以出事。

Supporting 文件有租約同物業condition嘅照片。

最慘係——
有啲業主以為自己文件齊晒,最後先發現文件錯咗,唔單止趕唔到個租客走,仲收到4萬鎊罰款!

所以,如果你係業主,依家就即刻check清楚你啲文件。

而家英國好多地區Council 可以唔使先警告,直接開罰單

最近 Reading , Portsmouth City Council 等等對佢哋租務業主,發出咗一個訊息:以前有啲 Council 會先出warning,再慢慢升級處理,但而家呢個程序安已經收緊咗。
換句話講,未必再有第二次機會。

而且新制度下,部分輕微違規罰款可以去到 £7,000,嚴重個案更可以高達 £40,000。如果一次檢查搵到多項問題,可以同時開出多張罰單,一次檢查可能會導致變成幾萬鎊罰款。

更麻煩嘅係,新的租約相關的違法行為覆蓋咗租約點樣開始、點樣管理、點樣結束,仲包括租客歧視等範疇。好多業主其實仲未真正理解,已經可能踩中紅線。

而 Council 通知由寄出到你收到、再打開,可能已經過咗幾日;而你真正可回應嘅時間,往往只得 14日,實際上可能淨返六、七個工作天去搵專業支援、整理證據、準備回覆。
所以而家最重要係:
第一,全面檢查所有物業是還是不是合規;
第二,整理好 tenancy 文件同證明;
第三,唔好忽略任何 Council 信件。

Huge congratulations to my lovely buyer who picked up their keys today! 🔑 This completion feels extra special.

用公司名義持有物業,原來都可以用Ground 1 收樓其實視乎結構點做?公司名義持有物業嘅業主要注意,因為limited company在法律上沒有父母、子女等親屬,所以有限公司業主絕對不能使用 Ground 1 收樓。
拆解方案 -如果業主係用公司名義持有,可以由「公司」將物業租畀公司shareholder 然後由shareholder 再將物業Sub-let比屋企人,因為shareholder係會有屋企人。咁樣一來,就可以合法使用 Ground 1 收樓畀自己家屬住。

Ground 1 業主或家屬需要收樓自住-所有細節及操作重點:

呢條例將會完全取代舊有嘅 Ground 1(舊例容許業主收樓自住後再轉租或賣出)。新例要求嚴格好多:
核心條件: 業主或其家屬必須打算將該物業作為他們唯一或主要居所。
合資格家屬嘅範圍比較窄(比《2004年房屋法令》更嚴),只限於直系親屬,由grandparents, 父母, sibling, 子女到grandchild.
不包括: Uncle, Aunt, 表親、侄
但係業主配偶(Spouse)嘅直系親屬(例如配偶與前度生嘅子女)都可以。
