A client asked us recently why we weren’t going to head straight to court to recover an unpaid invoice - and here's why....

We read last week that the latest Ministry of Justice figures, for January to March 2026, show a typical wait of 54.3 weeks from issuing a claim to a fast, intermediate or multi-track trial - that's over a year!

For small claims it's typically 37.6 weeks, that's still the best part of nine months with your money sitting in someone else's account!

Claims issued in the county courts are up 7% on the same quarter last year, to 527,000, and judgments are down 8%.

More people are going into the system, fewer are coming out the other side unscathed and with a result.

That's exactly why a proper Letter Before Action, sent early and worded correctly, does most of the heavy lifting. Most debtors tend to pay or negotiate once they realise you mean business.

Court should be your last resort, not your first move, because the first move now takes the best part of a year to sort out and is stressful and could end up being more costly than early negotiations.
